I will once again be writing and sending posters to all the reps. This is one of our chances where we can get closest. If we miss this then there will be lots of uncertainity. Imagine we already missed it. See how desperate all can get.
We have some time, Lets all spend considerable time this weekend, get bigger charts, use lots of good eye catching color, make our voices heard. Spend considderable time this weekend on this, please. Together we all can make a difference. Please do your best and spread this across your friends also who are waiting or have got their greencards. This one thing sucked up so much energy from so many here. Please support EB2 and EB3. How does one get these greens. I never got any.. :(.

yes, that is our line of logic and understanding. But seeing the number of experiences what we are having in real world, this does not seem to be applying. You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

(http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

If the post is true and from real world person, then the OP and his sponsor are in violation of the Law. The L1B are not supposed to be based/hosted in client location unless specifically stated in the approved petition. Defiantly not supposed to do in case of blanket L1B.

I think you are doing the right thing here. My question .. what are the typical signs you need to watch out for to determine L1 violations are happening? How do you collect information / evidence that ICE or USCIS could find helpful and act upon?
'Symptoms' of this violation are
1. If your outsourcing partner (TCS, CTS, IBM etc) brings in a lot of resources and places them in client managed and executed projects and all these resources are supervised by client managers then there is a violation (pretty sure that more than half of the resources from these companies would be in L-1B, please refer the statistics published in this discussion).
2. If these resources are used for any common technical skills (Java/.Net/Oracle etc) in their projects, then you can expect a violation because all L-1B petitions are approved by uscis/consulate for speciality skills/tools. If you verify most of these petitions they would be approved for some XYZ internal tool specific to these companies (couple of L-1B brothers where generous enough to share these information). If these resources are used for any other skills/tools then there is a violation. In case of Blanket L1 petitions its pretty easy because there is no blanket petition approvals for any common technical skills.
Hope its clear to you now, please try to educate your client management first and try to avoid such a scenario, most of the times these outsourcing vendors won't budge to open up these petitions and then you have to report these cases to the corresponding authorities. One way we are doing good to L-1B resources, they can ask their organisations to process H-1Bs using this oppurtunity and come out of the bonded labour.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. I always thought, the system was fair, it was only the overwhelming numbers of immigrants from certain countries that made it look unfair....but the closer I get to the stage where DOS decisions start impacting me, the more I realize that the system is not fair at all. The game of visa numbers and allocations is driven by white house politics alone...DOS being the spokesperson for the politics. Essentially the white house is directly throttling immigration through the DOS...on its own whims and fancy.
So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..
