I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.
What are my options now? I do not know if I am eligible to go ahead and file my I-485 now ? What are the implications if I go ahead and file my I-485 now.? Please let me know your ideas.

I have a question which I have been wanting to ask for a while, so if GC is for a future job then can someone incorporate a company and work for self on EAD/AC21. If there is query for ablity to pay then at that point can you have an offer from other company and work for that company for 6 months once you get 485 approved.

Everybody please post the names of attorneys who are easy / not easy, safe / not safe to deal with. People can post the names of the attorneys and a brief description (without specifics) about the problems / happy endings, they encountered. This could become an excellent review post for immigration lawyers. we could also maybe put 3 or 4 criteria to score them from 1 to 4. for eg:-
availability to answer questions
timely filing
acurate filing (with all documents)
current with legal provisions and latest changes
overall easiness to work with
cost
etc etc
Experts pls join in to fix the scoring pattern. We need to know the crooks and the good samaritarians out there.

Hello everyone,
I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks

Hi, i'm gonna explain my situation.
I came to the states on december with a J-1 Visa for the purpose of work and travel program, i've got a ds-2019, my I-94 is with D/S, and i got a SSN card with the "only valid for work with dhs authorization", also i dont have the 2 year residence requirement on the J-1 visa so i don't need to get a waiver for appliying to AOS. I was working in colorado for 3 1/2 months and my visa expired on march 30. I was supposed to go back to my country (peru) but then i went to texas to see my girlfriend that i haven't seen in a year, and we decided to get married, which we just did a week ago. She's a permanent resident, living her for like 5 years or so, but not a citizen.
The thing is that neither of us have so much money to fill the papers (she just got a new job after a couple months unemployed :( ), she's still living with her parents, and i dont have a job anymore cause my visa already expired so i decided to move to florida with my cousin (i've just got here yesterday), so at least i don't have to pay rent and he can help me a little. So we're both triyin to make some money to make this happen.
The thing is that, i know that working out of status is illegal. Right now our plan is to get money for her to get her citizenship, move together, and then apply for my AOS, work permit and everything. But right now i need to work. My question is, if i work with my current ssn, which i'm not allowed to, will USCIS forgive that when we apply for AOS? I have explained my situation to some people here, and they're willing to give me a job with my current ssn but i dont know if i should take it or not. Can i then argument that it was for getting the money to become legal or something. We haven't applied for aos now cause, affidavit of support (we dont have money he).
Well at least we're happily married and had a good honey moon in Austin, i'm missing her thought :(
Please comment and try to give me some ideas here.

Im just thinking aloud here. We want to be heard and we want to educate people as to how we are different from Illegal immigrants.
Why not post a question for the Republican debate? If our questions get selected and aired we will have 30 seconds of national television audience. We might even get some answers from some presidential candidates.
What i have in mind is get a few of us together, preferably people from different nationalities. Each one of us will hold a placard with
Legal Immigrant in bold, educational qualification, Federal tax paid, State tax paid, SSN tax paid and finally number of years in green card wait.
One person.. can then briefly mention what our issues are and ask what the candidate can do for us.
Each placard also has immigrationvoice.org on it...we have free advertising, we have airtime for free... and we have a national audience.
I know very well that the candidates answer may not directly help us.. but at least we will get some attention. Many many citizens watch the debate.
