    They moved from 8/1/2002 to 9/22/2002.
    According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
    Never mind the spillover, can ROW just get its normal quota at least?

    Now that your H1B from new company has been approved, they must have reopened the old one to send the notice to lawyer requesting them to confirm that you no longer work with them.

    Anyways since ur new H1 is approved you have nothing to worry... chill and Njoy
    This could be possible cos my previous employer told me that they have sent H1B withdrawal letter to USCIS a sometime ago. USCIS might have acted on that request. But we never know.

    I agree with you guys...especially even if they permit 485 filing pending the priority date...it will help a whole lot of people get out of their employer's tyrannical grip and lead a free life.....:) ...I only hope the SKIL bill gets passed in some way sooner.....

EB2 I/C is in for a really really long wait.
    Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!

    We need to let uscis know and audit all current and past approved cases from these consultants)

    FYI ...With support from a few people .. we are in the process of filing a Direct injunction for stoppage and immediate audit of interfiled/approved cases. But more support would be appreciated.

    The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.

    On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

    Hi,

    Its been two months passed since i got GC. My question is , Is it necessary to stay with employer for atleast six months after getting GC. Would really appreciate if someone helps me out.

    Yes, I have the same question. Everything is a good practice recommendation. That is confusing.
    And I thought it was one year. Is it 6 months?:confused:

    Hi All,

    You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!
    The best way to find out the reason for reopening is to call USCIS. But since this is a I129 petition only the employer or the attorney can get any information since USCIS will not disclose any such information to the beneficiary. If the previous employer agrees to call USCIS, things will be clear.

    This is applicable when 140 has been approved. If 485 is retrogressed then you will get 3 year extension. If it's current you will get 1 year extension. Guess depends on luck. For e.g if some one has applied for extension in July he/she will now get only 1 year. I found this in a lawyer's chat transcripts.


    yes i believe so. i applied my 8th yr h1 ext on may 16 and requested 3 yrs ext. with receipt date may 22. in june my 485 was current. filed for 485 end of june. file prob. reached there on july 2nd. fiasco announcement. july 17th mess is patched up saying dates are current. on july 18th i get a response from atty saying i got 1 yr ext. even though 3 yrs were requested. this is because my dates were current in june & july when they processed h1 ext. but it's a pain to process h1 ext each year based on 1 yr ext.

    With 'privillege' you have to follow existing rules religiously then if it was a 'right'.


    Well if we were to carry your reasoning a little bit further ...being a citizen of a country, any country, is only a privilege and not a right as you have to follow the rules and laws of the country.

    The actual difference is in the definition as has been pointed out earlier.....
    "right" - is something you can ask for because you think it is reasonably fair
    "privilege" - is something you are not entitled to or deserve but nevertheless get because someone condescended to give it to you.

    By the above definitions what would would classify getting permanent residence as.... the answer lies in the broader way of how we look at life and live it.
    Do we always live in fear and cower in front of real and imagined threats - the GC is then a privilege.
    Or do we live an honest life - do the best we can - and stand up for what we think is right or wrong irrespective of whether our lives are directly affected or not. The GC then is a right.

    Guys!!!

    Had it been the year like 1999 with all the efforts from IV, I am defintely sure the CIR reforms would have passed by now.

    Issue here is the economy, recession looming large on our face, unemployment level rising, and no one knows whats going to happen in the next two-three years becuase of credit crisis and oil price going above the roof. If this continues for another year, we will be in deep s***.
    Thats why no will dare to increase the workforce by issuing more grren cards. Atleast we should feel happy that they havent stopped issuing the cards.
    I know its painful to be waiting for years to get a GC. But you do not know how green that card will stay if the current financial crisis continues for 2-3 years.
    Fact is, this country is going thru a difficult period of uncertainty. Because of election year rhetoric, no one is going to accept it. But clearly, its not in their interest to get more workforce into this country. They know we have been waiting, and will continue to wait. Look at 2002/2003/2004, when they issued only 20K visas for the entire year. So just hope that things will get bright for this country soon else, we are in for an another hell ride.


    Why they are bringing the people on the Lottery. They give 50,000 green cards each year thru lottery system. 50,000 and inlcuding dependents atleast 2 = 150,000 people come. In addition this they give asylum to around 200,000-500,000 people. They come here and start from scratch.

    Most of H1B(s) are working here and estabished. If USCIS gives green card to H1B(s), it will not create any problem to the labor market. Infact it will give boost up to economy because people who get GC, they will start buying houses, luxary items and other investment to this country.

    best time to send money to india and keep it in bank there for sometime..u will best conversion rate right now....Rs.46-Rs. 47 for a dollar...also u get atleast 9-10% interest on ur money there...after 8-10 months when the picture about real estate gets clear..we should invest in property in india..
