It looks like this was an inadvertent statement of the President's plans before it was formally announced by the Justice Department. Secretary of State Clinton told an Ecuadoran television station: President [Barack] Obama has spoken out against the law because he thinks that the federal government should be determining immigration policy, Clinton said in comments first highlighted by a conservative blog. And the Justice Department, under his direction, will be bringing a lawsuit against the act. Predictably, Arizona Governor Jan Brewer is upset as is J.D. Hayworth, the anti-immigrant candidate trying to replace John McCain as Arizona's Senator. Here's today's...

I140 pending under EB3, non premium category with receipt date 2/1/07.
I have worked for my current company for 6 years. Currently in the 7th year of H-1B with 1 year extension until March 08.
I want to change jobs due to dissatisfaction with current work, and also due to possible future restructuring within company.
How can I change companies without having to go back or live overseas for 1 year and start the process all over again?
Thanks,

Hi,
I just became unemployed (today) but I obtained my GC through employment about 2 years ago. I have some questions:
I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.
Am I entitled to unemployment benefits since I have a GC?
Will my layoff create any problems for me when I want to become a citizen of the US in about 3 years?
Thank you so much.

You need to be one full year outside the US, however the year does not have to be continuous. So if you came back to the US for a month during your year overseas, you would need to be outside the US for 13 months to get H-1B status again. You will be subject to the H-1B cap again if claiming a new 6-year period.
As the previous answer says - you don't have to go back to your home country. You just have to be outside the US.

Thanks to both of you!
I just got back to the post to update it. Even I found through another source that https://www.usvisa-mexico.com/ is the new website for booking visa appointments at mexico consulates!
What makes me wonder though is the fact that tijuana us consulate website and nvars website still point to the old website!?

Yes you can apply for EAD and AP separetly anytime
The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.
I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now
Using AP to travel does not invalidate the H1...AP is just a travel document, and does not determine one's status in the country. The H1 would be invalidated only if the person switches to EAD.

I guess tricks isnt the best word to use, i have had photo courses, and have had the rule of thirds pounded into my head by many a teacher ;)
I'm more interested in the shortcuts and other features of the camera and settings. I know the basics of taking a good photo, but have a lot more practice.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

You can use AC21 because, 180 days is completed and you have approved 140 from employer A.
The amendment is to continue your green card process in employer B.
Note : employer A is old company.
employer B is new company.
I hope some of the senior people in this group can give you more correct information. Consider this information as my analysis, because I am also in the same boat.
Thanks.

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

Dear Friends,
I am in my 5th year H1b, my past efforts for GC have messed up. Now i am waiting for PERM withdrawal since Jan 09 to file a NEW PERM. Even if i am able to file a new PERM application by this month or next, what are the chances of getting it approved looking at the current scenario of economy and job market?
Thanks,
R.
