I have tried to explain the general approach taken by an American System in another forum. The moral of it is that don't think that someone (USCIS/senator/congressperson) does not know what they are doing. They know what they are doing and will continue doing it unless someone kicks their ass.
As an example, White House did not do the right thing with a Canadian citizen by sending him to his contry where he was tortured (the story was on last week; the person got millions from Canadian Govt). So far Republicans did not care about it. Last week a democratic committee chewed Gonzales's (in charge of USCIS also) ass. He said he will provide evidence soon.
I have been in similar situations where I have to do things not liked by some persons. I just act dumb and keep doing what I have to do unless someone much higher up chews my ass.
This is standard American procedure.

My wife got her name changed on the passport last week from the DC embassy. Her original Indian passport had only her first name and her last name was blank. Her US documents (Visa, SSN, Drivers License, etc) had her name as <first_name> FNU (Family Name Unknown). For a passport name change, the Indian Embassy requires you to:
1. Create an Affidivate in India saying that the name needs to be changed from <first_name> <blank> to <first_name> <last_name>.
2. Publish the name change in a national newspaper.
3. Publish the name change in a local US newspaper.
Along with the name change application, you have to submit the original affidivate, the paper clipings of the Indian newspaper and the local US newspaper.
Alternatively, if you have a marriage certificate and the marriage certificate lists your name as <first_name> <last_name> rather than <first_name> <blank> (as on your passport), you do not need the affidivate and a copy of the marriage certificate is sufficient.
The renew/change-passport-by-mail service that the indian embassy provides will take 10-12 business days (excluding Indian public holidays :) ). If you go in person to the consulate/embassy you can get your passport back within 3-5 days.

This thread starts with a call to all the EB2 people. Is it only the EB2 people suffering due to USCIS actions? Or are EB2 applicants a distinguised lot that they dont want EB3 to join with them?
It is so depressing to see the attitude of some of these guys !!! There have been so many threads explaining the difference(or indifference) between the qualifications of the applicants.
The suffering has been equally bad or even much worse for the EB3 applicants. I am an EB3 2003 applicant and my suffering has been equally painful. The campaign should be about fair treatment to every applicant, not alone EB2 or EB3.
Any campaign will only be successful when we try to do something together.
If you yourself are belittling the EB3 applicants, why do you have higher expectations from the American Citizens/Government.

Welcome to IV. There is no data available to us yet suggesting how many applicants that applied were for Masters quota. However masters quota would be definately filled very fast for you to apply this year before your OPT starts. We are trying hard to get an immigration bill bassed this year. This bill has a few provisons for international students in US universites and US educated students.
For a start read STRIVE act, for some of the provisions that will help students like yourself.

First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.
From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.
You can file for prosecution under child abuse and I am sure this case would be prosecuted legally, even though the care provider was un-licensed and illegal alien. Your proof however (video recording someone without consent) may be disputed.
But the bigger question is your admission of entering into contract with individual not permitted by law to engage into such contracts. This might be mis-denemor or something greater. Check your legal options first.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

Few big question we need answer tow
1) Why is there no forward movement of dates if there is visa was available from this year/quarter's quota... what is up with retrogression?
2) If visas were unavailable, why was the fucking date advanced to Sept 2006?
4) Why was FIFO not followed during adjudication?
3) How the Fuck long do they need to determine the backlog ..? we need USCIS to publish the backlog stats. Without that visa bulletins are pointless?

Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. It is very easy to fire when the gun is on someone else shoulder. We understand and share the frustration with green card delays, but that does not give you license to use derogatory language. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question.
