What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
It is not really a reverse-brain-drain. It is just less than 100% people on work visas attempting to stay permanently. Reverse-brain-drain will be when American born (or well established people) try to move to other countries. Some living here for few years, finding difficult to get used to American culture, food, life-style, etc., might decide to go back to their native country, but that is not reverse brain-drain.
Revere-brain-drain may happen in the future, but it is not there yet.

@SC3....Thank you for actually saying something that is productive to a discussion (Hingish...you are an idiot and it is quite obvious from what you had to say, which was absolutely pointless) I am NOT claiming to be lucky or more qualified. Like you said, some people suffered through BEC and LC's that took ages. Then along came PERM and suddenly people saw approvals in a matter of months. My PERM got approved in less than 30 days whereas my 3 year senior colleague had to wait for a total of 4 years to get his LC (his qualifications, designation all higher than mine).....so what is the point of this story...new rules lead to new games.
All this lamenting on this website is sad because it gives many people false hopes. All I am saying is that QUIT CRYING and JUMP into ACTION !!! No, not the action where you write letters and make phone calls and hope for the "magic email".....I am talking action in terms of get a new skill set, go to evening law school, think about shoving it up the system if need it (ie port your PD !! but please do not wait HOPING for IV or anyone else to do anything !!)
Do a comparative analysis of immigration and opportunities in europe. Find out about compensation, health benefits, retirement, education benefits in other countries.
DO NOT LET THIS GREEN CARD FEVER YANK YOUR LIFE AROUND.

Freedom and Liberty has been the founding principle of USA. Freedom to change, to improve and to grow has lured immigrants to USA over ages. However, same freedom is denied to LEGAL employment based immigrants. USA boasts of equal rights and opportunity to everyone. However equality is denied to employment based immigrants.
I came to USA in 2001 along with my family, to work as an IT manager. My green card was applied in 2003. I have been dutifully contributing to US economy, in form of my labor and taxes. However, due to immigration laws, I am stuck to a particular job profile. I can not accept any promotions or job enlargement offers. I am even barred from attending full time school, to enhance my skills. My dependents are not eligible to any educational aids, since we are not green card holders yet. I can not buy a house for the fear of losing it. In case of job loss, I have to seek a job in same job profile within 2 months, or loose whatever I have worked hard for in prime years of my life. In spite of paying all taxes, I am not eligible for any kind of unemployment benefits.
I have been waiting patiently for last five year for my green card. Looking at the snail pace of process it will be several decades before, I get it. Has US stopped caring about intellects at all? Why cant US politicians see a potential brain drain coming?
I request you to take reforming immigration process, making USCIS accountable on top priority. The law should also have a maximum wait period for green card identified. No one should be put through an ordeal of an endless wait.

Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
Incorrect.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
How does it matter?
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
Highly unlikely. The lawsuit could take one and half year (or more).
Even if judge rules on July 29th, usually a reasonable time is given. How did you come up with 2 days.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.
The big question is, how you define "ELIGIBLE applicants"?
Any lawsuit needs lot of time and patience. And none of emotions.

The point is what did we lose by calling. It took us a call which any way is free. Took 2-3 minutes of our time which other wise we were not planning to use in any other better activity. So even if the campaign fails ( I pray it does not) still we havent lost finacially or in any way. Atleast it brought so many people together to do something constructive. Made people understand how a bill works in senate.
To your other point that senetors do not care about non voters then then the only other way is lobbying and paying for campaign funds. Can we do that the answer is plain NO. Most people on H1B are working for blod sucking consultants who pa them far less than what they deserve. How much can they contribute financially if they have dependent wife an kid here and parents in home country. Add to this the job insecurity in current market and there is no guarranty that paying one time will bring any results. Least this way every one contributes.

if flowers campaign was a grand success, why not try this?
There is nothing to lose
Flower Campaign - Smart Strategy - Hence grand success
This - Foolish and crazy thought... forget strategy... Photo on a Grand Children's wall with garland(shoes) on it.
I sense " lost mind" just reading about this idea... So that is the start point for you to count what will be lost if this is done.. You or any other can add up other piles on top of that..

Very sorry to hear your case. Based on what you said, no one in other cars were disabled or had life threatening injuries. So it is unlikely that the Judge would grant that much money from the Insurance company or you.
You can always file for bankruptcy if worst situation comes. There is no shame in it in such circumstances.

Guys!!!
Had it been the year like 1999 with all the efforts from IV, I am defintely sure the CIR reforms would have passed by now.
Issue here is the economy, recession looming large on our face, unemployment level rising, and no one knows whats going to happen in the next two-three years becuase of credit crisis and oil price going above the roof. If this continues for another year, we will be in deep s***.
Thats why no will dare to increase the workforce by issuing more grren cards. Atleast we should feel happy that they havent stopped issuing the cards.
I know its painful to be waiting for years to get a GC. But you do not know how green that card will stay if the current financial crisis continues for 2-3 years.
Fact is, this country is going thru a difficult period of uncertainty. Because of election year rhetoric, no one is going to accept it. But clearly, its not in their interest to get more workforce into this country. They know we have been waiting, and will continue to wait. Look at 2002/2003/2004, when they issued only 20K visas for the entire year. So just hope that things will get bright for this country soon else, we are in for an another hell ride.
Why they are bringing the people on the Lottery. They give 50,000 green cards each year thru lottery system. 50,000 and inlcuding dependents atleast 2 = 150,000 people come. In addition this they give asylum to around 200,000-500,000 people. They come here and start from scratch.
Most of H1B(s) are working here and estabished. If USCIS gives green card to H1B(s), it will not create any problem to the labor market. Infact it will give boost up to economy because people who get GC, they will start buying houses, luxary items and other investment to this country.

Growing up I use to goto an organization wearing kakhi-chaddi, so I grow up hating Mahtma Gandhi (but that ws long time ago),
I now has so much respect for this Man, I wonder how was he able to cheer and integrate my fellow Desi's ;) almost 60-80 years ago, if I think about it now seems almost like a miracle.
We really need to look into his life and find some answeres, as we have long battle and it is just getting started

is not right.
The hardships we have chosen to enter united states and struggle here is of our own choice. It was an option. You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
We all have options and it depends what you choose.
Just because few centuries ago someone entered this promised land just like that, you can't expect that to be existing now or atleast a modified version of it now.
Again, i believe the immigration system can be improved only if senators can taken into confidence about our hardships. Striking the way illegal mexicans did and or raising slogans like 'immigration is a right and not a privillege' may play against us.
just my 2 paise.

You are right in that the donation would go towards the core IV funds. But if we resort to writing personal checks and What if it is short of the amount he spent ? Should he wait for months if not years to realize the amount he spent ? I think they should be compensated immediately from the core IV funds.
---
Can someone from the core tell us if there is a possibility that we can request IV to reimburse Aman and other core members for their past expenses and institute a prosess for expense reimbursement going forward

Let us list our the reasons for not complaining
If you are on a H1B
- Employer is withholding pay for 4-8 pay periods and leaving the employer would lead to losing the money
- DOL and USCIS will not be able to recover all the money the employer owes per the employment agreement even if it reported. They might only recover the $$ mentioned on LCA
- Employer does not run paychecks periodically so it might be hard to find Jobs and do a sucessful transfer of H1B visa and start the Greencard process all over again
I485 filed cases
- Employer withholds documentation and/or does not share documentation related to Labor/140 etc to be able to utilize AC21
- The Job description that was communicated to the employee while filing the Labor does not match the employee's field of work and the employee has not reviewed the LC prior to signing
Anything else?

USCIS could be making a determination that the 140's company is now revoking were approved iun error and people are not eligible for ac21.
If it is determined that that is indeed why they (USCIS) denied a certain 485, and then the applicant proceeds to hire/seek the help of competent lawyers and accounting professionals (Im not naming anyone here :)) to file an MTR where the old employers ability to pay for that particular employee (from the time of filing the labor until the employee left the old employer/submitted AC21 documents) is demonstrated via the employee's W-2s, do you think the applicant has a chance to get the 485 re-instated?
I'll keep everyone posted of what happens to this case.
Thanks, highly appreciated, as always.

We would be happy to know from core that your expenses have been reimbursed. I am sure, Jwalant, Himanshu, Prsatik etc.. all have contributed apart from Aman.
Offcourse the time spent cannot be reimbursed, but definitely money can. Its wrong on part that one has to shed so much money.
