Great! I sent individual messages to all senators through their websites and was able to send a 'hand delivered' message to Jeff Sessions for $8.95 through following website (https://ssl.congress.org/congressorg/mailapp/).

guys i posted flyers in areas around LA at Artesia, Temples/Grocery stores around Orange County. Will do more of posting around LA. If you know of places around LA where there can be more of Indians, Chinese, Filipinos please let me know I will post them and try to talk to people around.

I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.

I am with you on that one :) No point taking a risk for a few dollars.
As I already mentioned it is not about $$$. It is about getting an appointment at consulate. Anyways, I managed to prepone the appointment now. So everything should be smooth.

Talked to an io at neb sc.within 5 sec of me starting to talk the ffice interuppted and she apologosed for doing that and said because of huge vol of appli there is a delay in the receipt notice.i SAID I AM july 2 nd filer and she said it might be in the first week of aug..(i had said the same thing in my earlier post too after i spoke toa diff officer)..She asked to keep checking the check clearnace.

Looking at the .PDFs and the law on spillover, I agree with MPADAPAs analysis. Still hope that there would be spillovers from unused EB visa...sure it will be less compared to last year....but atleast feel/hope it would be enought to get through 2006....atleast for EB2 guys....

Understand that, but do you really think (s)he is worried about that at this moment any more than his next board meeting with the board members and CEO. Not increasing H1B quota itself and allowing lottery for highly skilled program, go figure sends some signal that they do not care if you graduate from MIT or from an unknown university in tahiti. How do you really test highly skilled??? by lottery?? dah!!!
From a senator or CIO level of view if you can get it cheap why not. It comes down to Toyota carolla or Mercedes CLS550 when you are only concerned about getting from point A to point B, enjoying the ride is not in question here.

I spent 3+ months after application with out a passport, because my earlier Indian passport was issued in Sweden and SF guys want clearance from Sweden.
The ugly part is SF guys don't know how to communicate to their brothers/sisters in Sweden! Every time I en-quire they show fingers at Sweden embassy.
I use to wake up 3 in the morning to find out what the issue is with Sweden folks; almost all the time the ans is 'they did not receive any such clearance request from SF and don't have any procedure for the so called Clearance...'
With two different time zones and no direct phone support for SF consulate, it was hell to deal with out talking to any one in SF. Their phone line is a joke.
After 100's of emails(count less phone calls middle of night) with both consulates with some ugly and strong wordings(some times literally begging!), finally they issued my passport. I felt so happy seeing that than when I got my GC....and I lost valuable time window to travel.
God bless all those who wants Indian passport renewal at SF

What I am finding is, there are not enough people to do the really complicated stuff. Because of demand and supply the salaries are going up for folks that do specialized tech work( say OS Kernel development).
Then again, nothing in this world is too difficult, so lot of this stuff is getting pushed out to development teams outside of the US, where it's cheaper to get it done. The only downside is the ramp up time.
There is a critical point when it becomes too expensive to hire anyone in the US and the folks elsewhere are sufficiently ramped up, at that point we can thank all those who are against employment based immigration and find an alternate career :)
It is also obvious that the current graduates are more reluctant to take up jobs in US or stay here for a long time due to the following:
1. Messy GC process as more students are becoming aware of the situation
2. Ability to work freely in a competitive environment
3. Boom in their home country (India and China) [A survey shows that majority of foreign students are from these countries]
4. Ability to start at higher levels over there compared to start up jobs over here
5. Can stay with family
In our team, we are trying to hire 3 full time employees in west cost with specific skill set and could not succeed for the past 6 months :( One of my friend who is leading a team, recently want to expand his team had a similar issue. He finally setup an office in India and recruited people over there.
These trends clearly indicate that US is loosing clear competitive advantage and more jobs are moving off-shore.
If for some reason I move back to India, I am sure that I will be taking away as many as 10 jobs along with me as well :)

I think it all started in 2007. As you guys know there were mass applications filed in 2007 from everyone who were current including EB2/ROW/I/C and EB3 /ROW/I/C.
AFAIK, close to 1 million applications were filed during this period if you include 485s , EADs and APs and all by all the folks.
All was fine until this time and then came 2008 where some people who were still on H1 applied for EADs and APs as USCIS started to give EADs for 2 years.
Then in 2008 there was a new rule put in place stating that there need to be an Employer-Employee relationship for the people working on H1, this has created some kind of panic among employees and employers and people started to invoke EADs left and right thinking it was not safe to continue to be on H1.
And since then as the economy started to take toll, people were laid off and employers were not willing to transfer H1s as they were too many queries on H1 extensions and transfers. Everyone thought that it was never to be safe to be on H1 and started to invoke EADs either to change for better jobs and people looking for jobs also invoked EADs as it was easier to move..
Then came Oct 2009 and we saw that not many Labors are getting filed by EB2 ROW applicants and very few employers were filing Labors as the Unemployment was in 2 digits % wise and were not able to convince DOS on non availability of citizen/PRs workers to do same or similar jobs.
Also most of the Labors were audited and it took close to a year to clear all that backlog before people were eventually approved in EB2-ROW applicants, until we saw July visa bulletin which raised our hopes.Based on the spill over they were supposed to approve close more than 40k EB2 I/C applications in the last 3 months of the year.
But there was a twist in their understanding. As most of the people who got EADs in 2008 were ripe for renewals(this includes EB-2 ROW/I/C, EB-3 ROW/I/C).And hence applied in mass for their renewals. This caused a huge delay in approving the EAD renewals and you have already heard sad stories about it..
Out of all this, All I can say is that USCIS was working harder than ever during the past 3-4 months to approve so many cases and hence I assume there is a genuine workload to clear all those cases.
Based on the approval trends, I think they have already allocated visas to the applicants who were current and started to approve as soon as the case has been looked into unlike what they used to follow of requesting visas after final verification.
Remember USCIS cannot give an excuse of not utilizing all the visas for the current year and blame on FBI name checks and all , as they had 3 sweet years to adjudicate the applications. And I guess they were under tremendous pressure to approve the cases by Sept 2010 month end.
Just my Honest Opinion.

Any voluntary job is good in resume. The resume is to show how you are and what skills you have. Volunatary job shows that you are not the one who wants to be idle and also it shows that you have some intention to do service to the society. It is good to have those in resume and also it will help you a lot if you pursue MBA in future.
My wife is also doing voluntary job for more than a year and on side I had to pay for my child care. Still it is good as she gets some contacts, diversion from routine house hold activities and my kid gets to socialize with other kids.

Did you recieve the RFE yet ?What was it about. Mine is a similar case. We both have LUDs on 02/10 and my wife's 485 recieved an RFE email today.
Not yet. Did not hear from my attorney either. My 485 got another LUD today. Did any of the folks receive the actual RFE? Please post details once you get it, and I will do the same.

My 485 had LUDs on 02/10, 02/13, 02/17, 02/18 and 02/19. My wife's 485 had LUDs on 02/10, 02/13, 02/17. My wife's 485 got a RFE on 02/13 - but still waiting for the actual RFE for the details.

Do not despair yet. We were repeatedly told that bills take a lot of time to pass. Never the less we'll keep working on this bill and this also precisely why we're not pinning all of our hopes on only the Comprehensive Immigration Bill. We also have the PACE bill and the TALENT bill, which can bring a lot of relief to us.
Are there any plans by the senate or congress to to bring these two bills to the floor anytime? In other words, what is the current status of these two bills?

There used to be a time when the ability to apply for I485 even during retrogression. was of the highest priority for IV. Now majority of the IV members (hopefully) belong to post I485 filing group. Now the amount of green cards for employment category, exemptions from quota for family members, US degree holders etc, and country quota may be the higher priority issues if one goes by the numbers.
