You are purely thinking about your perspective and neglecting the purpose of GC for the country.
To qualify in EB1/Eb2/EB3 depends on some factors:
EB1: Extra ordinary candidate, may or may not be represented by employer
EB2: Senior Level: Job duties have to justify need for advance degree candidate (or BS + 5yrs exp) and then candidate must qualify too
EB3: 16 years of education (ideally) with degree in related field (lets talk IT for now)
Now current status and its cause:
EB1: - No jumping, no gaming system : Hence NO DELAYS
EB2: - Good chunk with genuine apps, some gaming system where applicant qualify but not the job, some gaming system and taking very high risk by showing BS +5 yrs (they actually don't have +5 factor), other jumping the category (legally :D) but taking very high risk for RFE
Result: Got retrogressed
EB3: Good chunk with genuine apps, some unfortunate ppl who do qualify but job doesn't support experience or higher pay, lot of gaming system with BS (3yr) in non Computer/IT and showing 1yr certifications etc, and everybody who does not qualify for EB1/EB2, lot of nurses (I heard someone said nurses in back)
Result: Severely retrogressed with no hopes in horizon
Now lets look at market demand ( we know supply of apps is pretty darn good)
EB 1: Very very high : general pay range starts from $250k+ and goes up to $400k for fresher (PHDs) and in upper $150k for Int'l Managers
EB 2:: High, general pay starts high $80k and goes somewhere $140k+,
EB 3:: good, starts from upper $40k and goes somewhere $65-70k, (lots of job and lots of applicant)
Now lets take a look at Supply of Apps (Assumption 1M apps already in system):

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

There is also a 7 percent cap for each country. The sum of family and employment visas for china and india cannot exceed 25,000 approx as long as ROW is oversubscribed.
IF excess visa from EB2 ROW overflows to to EB2 china/india, this would clearly violate the 7 percent limit as the sum total consumption of visas by these countries would be well over the 7 percent of employment visas. Unless the overall demand for employment visas is less than what is available, the 7 percent would clearly apply.
The only thing that I feel might happen would be any unused EB1 china/india visas flowing down to EB2 china/india.

(3) Skilled workers, professionals, and other workers
(A) In general
Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?
We shouldn't assume that USCIS is too dumb to follow the law..

I guess, what logiclife is doing is right. It is correct to defend the organization and also respond to personal attacks in a befitting manner.
When i joined this organization, the only thing on my mind was to be part of the force. I was not expecting anything dramatic out of this. I cannot alone do this job, so i thought why not be part of the team which has committed to fight for a just cause.
Instead of infighting, let us unite and offer suggestions for better results.

I collected my passport with the visa stamped yesterday from the VFS center in chennai. I sent an e-mail on tuesday to the consulate and i got a response from them saying it could take another 4 days approx and the delay was caused by the recent change and the introduction of the PIMS database. It looks like they are digging through your old records as well.
For those people whose passports have been delayed, it's most probably due to the PIMS database and i suggest strongly to send an e-mail with the subject line "PASSPORT PENDING for more than 5 days" and you would most often get the response the next day. Do not call the consulate as they don't tell you what you want to hear. The person who answers the call is an indian and he/she would not have much information to give you.

Thanks for the reply and it is not an subsitute it is an original case .so your suggesting that my PD should be May 2007 instead of April 2001. But the problem is that attorney filed the labor certification in 2001 without obtaining the PW and now the PW has come up 71656/- so there is a huge gap what I was getting in 2001 and then we requested PW for the last years from 2001 onwards and now they are telling that they can not do it also if we download the PW from the archives it is still much more than the PW send by DOL. so is there any way to get the PW for those years in back. I hired a new and very capable attorney but what he is suggesting that if we could the PW for 2001 what we applied in application then it is a piece of cake. My occupational code is 15-1031 and it I filed from California, LA county. I will really appreciate for your guidance and suggestion

My attorney had filed 140s for in EB2/EB3 and I hope they have not taken my app and classified it as EB3. We sent the EB2 I-140 with the AOS app so I dont think that would happen but stranger things have happened with USCIS.
Response that I got from the local senator and from what I read in the other thread you created, I think visa numbers are over for 2009 fiscal year. We will now have to wait until October. I dont mind waiting until October, but I want to use the next 15 days doing whatever I can, so atleast in October, I have some chance of getting approved.
