    i personally vote for "one step at a time approach", which is been thoughtfully discussed and hand-picked , especially after thinking all the limitations we have in terms of $$, political support, member support, contribution support, etc etc

    remember:
    on every bill and every single effort we try to make after all these pains, every single mistake we make will cost us 6 months or more before we re-group educate memebers and others about what we can ask for in the next and satisfy IV members.

    filling up bills with each and every single problem has taught us some lessons. so we decided to go small to see how it works. every single retro prob has dependancy on others. so as logiclife mentioned solving one will ease the other one or indirectly solve other issues. im not that good in explaining all those, but i can try one.

    EG: see the scenario where H1B is not happy seeing H4 not being able to work. If our I-485 filing provision gets through, he/she can apply EAD for his/her dependant and all are happy.

    dont always think "H4's cant work" "H4's cant work" "Compare with L1's".
    im sure core team might have thought thru about a million times what needs to be done, when and how with all our limitations.

    its a matter of just 15 days wait to see what we get. why throw in more and confuse people. dont we have even a little patience?

    remember, one thing for sure - every single mistake we do from now on - the waiting punishment may be in years. and its for sure the retrogession will be solved in the future sometime, but no guarantee- in our living time in usa.

    In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
    AFAIK:

    AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.

    The above is just FYI.. You can google for more info.

    AC21 is a law. AC21 Memos issued are guidelines that IOs are supposed to follow. E.g. If one IO issues NOID if I-140 is revoked and another denies I-485 directly then the latter needs to explain why he/she chose to not follow the memo. In any case, there should be consistency across board to follow AC21 regulations.

    I know you are not threatening to leave. But eventually some one will. It always happens when one or other item is included or excluded from agenda.

    Anyways, this isnt about looking weak or strong against anti-immigrants. That is really not the issue here.

    Its about how much we can have in our list of items. There is only so much anyone can do. Forget about us, even bigger organizations have priorities in order. Immigration Voice also has to have a priority. We cannot talk to anyone about fixing the H4 issues before the issues of retrogression are talked about. And we cannot talk about ALL OF THEM because there is room for only so much to talk about. There is a limit on everything. Limit on how much funds we have, limit on how much political capital does our lobbyist spend on our organization with lawmakers, limit on how much leverage the lawmaker uses to sponsor an amendment for us. No one has unlimited capacity to get things achieved. So in that sense, H4 issues really cannot be on the list. And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief. Now tell me, how is that not tied to H4s. EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.


    Logic - Do not get disheartened!!!!! IV will thrive.. Quality in membership is better than quantity.

    I do beg to differ, nice post but low on facts, its more conjecture and assumptions.
    PHDs - EB1 dont make the kind of cash you have shown (ask the post docs who are working there asses off), similarly EB 3's are not restricted to the range you are talking about.
    Gaming the system is what screwed us, its not just EB3 its every where. The ones who gamed the system already have their GCs. The extent of gaming in EB1 and EB2 was more than EB3 (ask a lawyer, off the record and you will know). Bodyshopping companies send every one as project managers and they apply in EB2. as for experience, lets not get into that, it is very subjective and vague. I could go on and on...but my level of frusturation with USCIS is too high...hoping and praying is also not an option these days.

    We pay taxes PLUS Social Security for which we dont get any benefit. Dont miss that.

    Let us be assertive about that.

    Not sure if the social security taxes are for immigration benefits. Also, the taxes we pay are for several other services that we get in the US. Remember, even as non-citizens, we get millions of benefits such 911, clean roads, and the list will go on. Why do you think we want to immigrate in the first place? For example, if a law is passed to return to us all the taxes that we have paid but we must leave ASAP, how many will be in its favor?

    I don't think this kind of an argument will hold any water with the press or lawmakers. There are other good VALID arguments, and we should stick to them.

    I agree that MBa can help your career but I am not sure what kind of return I can get for 3 years and 50 K.

    In my opnion starting your own business is always a good idea, of course with uncertainities with GC process it is another risk added to the enterprise.

    In my opinion, doing an MBA from a good school can open up doors to further growth in a comapny. With jsut technical skills it can get stagnated.
    Age should not be a restraint, but with age comes other responsibilities of familiy etc, those could be more limiting.

    I think doing MBA from a good institute is good idea, India is really humming and has lot of growth opportunities for MBAs.

    I understand your frustration. Believe me I have gone thru the same.

    When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.

    One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.

    I know, the wait time is long, but it is worth it every bit.

    Hmmm so you have been a victim of random processing too? The situation is a mess no doubt. But this random processing really hits where it hurts the most...

    IF ONLY everyone who gets a GC approval or citizenship could work at the CIS for a year... a sort of community service.... All of the problems wrt the random processing will go away...

    I am sure most people on this board can hit the ground running and don't require extensive training... unlike the present day IOs.

    I think you got a very good point here.

    If India is really good economically, people from all over the world would be going there and find job.

    There are people from even poorer countries coming to India for education and employment and so.

    I agree that property is getting expensive by second in India, Some times it makes me think, most of us who wants to go back might not go back for wrong economical resons, Don't you think this is what happened to many people who migrated to African countries before Indian Independence. Most of them never visited India in their life time(I attribute most of them to economic reasons). I am not if this is a paradox or anticlimax.

    Congress has failed to pass immigration reform, so industries that depend on foreign workers have already been left in the lurch. But Senator Chuck Grassley now wants to make things worse.

    Last week Mr. Grassley, the Iowa Republican, slipped an amendment into a spending bill that would tax businesses that hire skilled immigrants an additional $3,500 per visa to a total of $5,000 each. According to the National Foundation for American Policy, this represents a $3.1 billion tax increase over five years on some of America's fastest growing companies.

    Companies employing foreign professionals who are here on H-1B visas already pay $1,500 per individual. The fee was originally set at $500 in 1998, but at least past increases have also included a rise in the number of available visas. When Mr. Grassley floated this tax back in April, it would have been part of a Senate bill that lifted the H-1B visa cap by 50,000 and put in place an escalator provision that allowed market demand to determine future increases.

    But the Grassley Tax proposed last week includes no such trade-off, leaving the H-1B visa cap of 65,000 per year intact. The need to increase this arbitrary quota, if not eliminate it, is clear. This year, the U.S. Citizenship and Immigration Services received approximately 120,000 applications for H-1Bs on the first day they were available.

    In addition to the hiring fee, current law already requires H-1B professionals to be paid the higher of the prevailing wage or actual wage paid to Americans in similar positions. So it's not as if U.S. businesses pursue foreign engineers, computer scientists and the like because they're cheaper to employ. Nor are these foreign workers overrunning the country and displacing Americans. In 2006, new H-1B professionals comprised 0.07 percent of the labor force.

    Citing anecdotal evidence -- "People have called our office," a spokeswoman tells us -- Senator Grassley says the fee increase is necessary to combat abuse and fraud. But the back wages owed to H-1B hires amounted to just $4.6 million in 2006, down from $5.2 million the previous year. In a $12 trillion economy, those numbers are infinitesimal. Department of Labor investigations reveal that some 90% of violations are paperwork offenses and good-faith misunderstandings.

    The Senator also maintains that his tax increase is needed to fund more federal programs for high-achieving U.S-born students, who are notoriously underrepresented in math and science. Leaving aside the dubious notion that the federal government doesn't spend enough money on education, the high-tech industry has already shelled out more than $2 billion to fund scholarships over the past decade. And that's not counting their other philanthropic efforts, nor the state and local taxes these companies pay to support public education.

    Mr. Grassley's justifications notwithstanding, the reality is that these skilled foreign nationals help U.S. companies compete globally and keep jobs and innovation inside the U.S. This is especially important when other countries are opening their doors to this human capital. The European Union, which says it's facing a shortage of some 20 million skilled workers over the next two decades, has announced plans to streamline its immigration process to attract foreign talent.

    So while even European bureaucrats are wising up to the importance of attracting global talent to keep an economy competitive, a Republican Senator is joining liberal protectionists to move the U.S. in the opposite direction. Go figure. If Congress can't see its way to fix our broken immigration system, the least it can do is not drive more jobs offshore.

    I'm startled to learn that The Wall Street Journal seriously believes that an investment in American students will make things worse for U.S. businesses ("The Grassley Visa Tax," editorial, Nov. 2).

    Your editorial asserts that the number of foreign workers on H-1B visas is so minimal that we shouldn't care if Americans are in fact displaced. I challenge the Journal to wave their labor force figures in the face of one of the hi-tech workers who have had to train their own replacement who is an H-1B visa holder. That's a smack in the face to the American worker and hardly an issue to take lightly.

    I am committed to an effort to include additional H-1B reforms and increase the visa supply along with an increased investment to educate Americans. But, I strongly disagree that the only solution is to increase our reliance on foreign workers by raising the annual cap. Reforms to the program must be a top priority. Big business cannot continue to ignore the home-grown American talent who should be getting at least a good portion of these jobs.
