    You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.

    And what is this with so many reds besides my name..wat is this?? Ppl venting their own Frustration on others.

    I read that filing EAD after I140 is already part of IV agenda. You can either donate or volunteer for it. Write to IV about it. I read that snathan had one idea and he volunteered his time to IV for it and got that done from USCIS. You can do it too. Most of us here have EAD so people who do not have EAD must take initiative.

    Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what would you have bid for the right to submit?

    Maybe $640, $6,400, or even $64,000?

    If Uncle Sam charged a fee to submit now rather than waiting for another year or two or three... What would you have paid to submit I485 and get EAD AP AC21?

    Alternatively, how much are you going to benefit from EAD AP or AC21?

    AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
    AC21 -- maybe not going to the back of the queue -- really worth thousands!
    EAD for you and spouse -- maybe a week of salary for someone that could not previously work?
    AP -- how much is it worth not to have to waste time and money renewing H1B at an embassy. That's at least a few days of time you don't have to waste (and time is money).

    How much will you save from filing under the old fee structure? At least a few hundreds.

    Now use that as a guideline for what you are going to contribute to IV.


    There are still problems ahead for most....
    * retrogression
    * BECs for unluck some
    * name checks (I personally know someone that it took almost 2 years for).

    IV is now the most credible organization there to help get these issues addressed. So let's hand over the $.

    the mailed date was recently added as a column.. till now ppl were using receipt date column as application reached.. wait till fp dates and notice dates get populated...the earliest i have seen is for ppl current in june who have a receipt date of 06/29

    I guess I feel more and more hopeless by each second/minute

    My PERM application (5/28/07 PD) stuck at Atlanta
    In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.

    Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..

    I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....

    me...really sad....

    Yes. It was pending LC and they approved my I-140 last week. The status update happened immediately after my I-140 approval.Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ? Yes. It was LC that was pending with my previous employer. Were you paid the prevailing wages mentioned in the LCA of previous H1B ?
    Yes. I was getting paid little more.
    Can this be supported by the W2 of last financial year [Not the paycheck].
    Yes.
    Did you have I-94 attached in the previously approved H1B ?
    Yes.

    Please answer these questions it might be helpful in finding what might have raised the red flag.

    Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
    If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

    I don't want to discourage you... but sorry i have to say this :D... I really hope you set an example by going back, but your blatantly obvious lack of intellectual acuity will not result in any brain drain... so the net result of you going back would be a simple one i.e one less in the line for GC ;) (not sure if you have dependents - actually not sure if you are waiting for GC)

    I also got email from CRIS last night stating that my I-129 has been reopened.

    I have a very simple immigration history:

    I-129 filed and approved April 2005, petition expires 3/30/2008; only ever worked for this same company.

    No H-1B extensions ever filed, no H-1B transfers ever done, no previous history of US immigration prior to April 2005.

    Labor, I-140 and I-485 were filed November 2006; I-140 approved February 2007, I-485 approved June 2007, EB2 green card arrived June 2007.

    There was a LUD on the I-140, in August, but that was about the same time as a bunch of other people got LUDs on cases starting SRC07... seems like I can disregard that.

    There was also a LUD on the I-129 without a status change later in August. No explanation for that was apparent.

    And now I get a notice on 10/23/2007 saying that the I-129 has been re-opened and that something will happen within the next 30 days. I'll be sure to keep you all updated if I get anything like an actual I-797 notice through the mail.

    Did anyone else get anything on October 23rd?

    Friends,

    There is a rumor going around now. One of my colleagues here claims that he got a call from his attorney that there is going to be a new bulletin for july, released either tomorrow or on Monday. Can someone talk to their attorney and confirm this?

    I'm unable to reach my attorney now.


    Man, this is becoming unbearable now. Although it seems to be the right thing given the news that USCIS has returned some visa numbers to DOS, I think they won't do it for the fear of looking like fools and humiliation of their mistakes publicly

    I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.

    There could be some background processing going on.

    Is there are pattern to these LUDs?

    What steps did you take after the NOID on your 485? Just curious in case it happens to me.

    There is nothing to enforce. If there is any, they would have enforced long back. It is too broad. But increasing fees won't make any sense. They have to correct the law, not imposing higher fees to everyone.


    1.Audit the companies that are suspected to abuse the H1B program i.e. enforce the laws that are already in existence.

    2.Impose heavy fines on these companies.

    3.Use this money to cover the costs of auditing and enforcing the laws.

    How will raising the H1B fees for everyone in a blanket fashion address the current "abuses"?

    Actually, not all he said was wrong.
    We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.

    My own employer was trying to get as many H1s as possible without having ANY work for them.



    This is also due to the fact that because even they have no work for all the H1B employees, they file for H1Bs in bulk, for they know that they don't have to pay people on bench, even though by law they are supposed to...

    But most importantly we are concerned with visa recapture and GC reform in the long run..If H1B reform is the step towards that goal then that would be good..

    You're welcome. Even while we all suffer due to the retrogression, most of which is out of our control, I believe we can still remain positive in areas over which we do have control, like our sense of humor and ability to get along with everyone by agreeing to disagree in a civil manner. Unfortunately this forum of so called "highly skilled" sorely lacks it. Every disagreement/debate becomes personal and quickly dissolves into a shouting match. It's really sad. We need to learn to be happy for others who are more fortunate and sympathize with others who are less fortunate. We don't have to be highly skilled to be that...just human.
