It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.
Which form is more gruelling, you folks decide. Here are the 111 questions you need to answers to get a Transit Visa. I centainly find some of the question totally nosy and irrelevant esp. for a DTV. The last question is interesting. I was so so tempted to write FU for an answer.

My wife got the approval on Oct 5th...CPO mail was first followed by approval notice and I also got a CPO mail after 35 days of approval....strange and surreal it seems

I may be wrong since my wife's case was separated.....But this was from my congressman's office who told me that the reason that her case is pending and delayed is because our case got separated during adjudication.

(Even nitty gritty details like which day and time the Immigration Officers generally will be in a good mood to hear us - Yes its true that our situation without GC is that pathetic). It might be so helpful for others who are still waiting to deal effectively with these officers. During my conversation with one IO, she told me the IO's ID who is reviewing my kid's file and asked me to send a detailed mail to that IO.

The problem with IV core is they want to solve all the problems at once...which never going to happen... I really do not understand why they are not making this as an Action item and raise donations. let us make this sri1309 letter final and start sending it to congress (house, sensate members)

2. Visa numbers wasted by USCIS by their inefficiency
EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?We always find it easy to go against fellow immigrants than fighting the injustice at root.

I agree with you that the main reason for the GC delay is the two causes you have mentioned. The Country cap is based on the current law (I am not saying the law is good). However along with the main causes for the delay the fraudulent uses of EB1 visa #s are also causing extra delay. Thus along with the effort to remove the main cause of delay we should work on the other cause of delays too.
I am also agreeing that as per the current law the L1A - Senior Level Manager can get their GC processed as EB1 and get GC within six months. I agree that this is the current law.
My main concern is the misuse of this law. People who should not get L1A visa are getting L1A using fraud and taking the EB1 visas which otherwise as per law would have trickled down to EB2.
You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".
You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.

Sorry to hear that. Hope that will not effect your I-485 application processing.
For me, I have not seen any status change to my 140. After a series of LUDs to both 485 and 140 at last today I see my 485 status has changed. It says RFE sent. Good that I have not received any NOID or Denial. This is the best case scenario that I was hoping for. I have yet to receive the RFE to see the actual cause. But hoping this is due to 140 withdrawal. I thank the IO who is working on my case as he/she is quite knowledgeable and issued a RFE not NOID or denial.
So people please keep sending letters.

How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

Yes..OCT bullettin holds the key to EB-3..if its bacck logged..then EB-3 call SOS and port to EB-2..none else will work
I have read it in Ron Gotcher's forum that what Sept bulletin talked about was only for Mexico and people should not mix it with EB-3 India. Also Apr'2001 was the PD given to the asylum(245i) cases by the Clinton administration. But with dates moving to Nov'2001 I believe that hump have gone past. My personal belief is EB-3 India should go around Jun-2002. But In case it remains in 2001, EB-3 Indians should take some drastic decisions. You may call me pessimist but I don't see any help coming from the congress, rather there could be some weird irrational decisions which could leave us paralysed. There are more foes than friends in the congress and lawmakers do what there pupil tells them to do. Right now the under current in US is anti immigrant..

Hi,
Can anyone share their expert views on this scenario.
Say, I have approved I-140 (current PD) from employer A (never worked with). Work with employer B in a different. Now if employer A applies for I-485 and after it is pending for 6 months, Can I invoke AC21 to continue the GC process while still with employer B ?
Also is it possible to have 2 separate I-485 filed from different employers.
I have heard the above is possible. But, I am curious as to how AC21 is interpreted. Isn't AC21 essentially an instrument to change jobs without hampering the GC process. In this case since one is not 'really switching jobs' how will this be treated or possible ?

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.
The percentage of people here are a very small percentage of that 25%.
H1/L1 restrictions are not going to encourage american kids. It does not impact their thinking. Maths, science are tougher subjects for kids. Kids in India were pushed by their parents to study science in search for a good career. Kids here have a lot other avenues which are more attractive to a kid. Kids do not understand L1/H1. 90% of adult population here does not understand H1/L1. REstricting H1/L1 will not influence a kid to take up science and engineering.
