Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?

Just couldn't believe how much the IO knows about. They are just so mechanical in actions and they do not even know the basic understanding of various bulletins. :mad:
I pity on your experience and it just shows how important to record keep every communication you make!!!!

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo
19) I went back an hour later with the print out
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today
26) We waited for 2 hrs and then she took us inside.
27) Asked our passports (to stamp...really)
28) Then she looked into the computer to get the visa #.
29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.
30) The officer said, per visa bulletin u r current and ur PD is dec 2005..there is no reason for system not to allocated a visa #..

I agree its tactic to scare people and attract attention. I think USCIS is far better placed today in 2009 compared to what it was in 2007. If that was not the case they would have just moved the Priority dates to Mid 2006 like they did last year. But this year they are much better prepared in their estimates. In Oct the dates might go back but it will definately not go back to Jan 2000 or U. They might take them back to mid 2004 and start slow advance from there. Next year Sep 10 bulletion hopefully they can take them to early. I am sure in Oct EB3 I will also come out of U and will be some where in early 2002 status at begining and will advance from there on.

Hi,
My wife is in F-1 status, but I�m afraid to change to F-2 right now and loose the opportunity of transfer the H1 to a new employer... unluckily finding a job has not been an easy task, since I am in Puerto Rico and here the situation is not good.
My last paystub is June 14th, and I was wondering to apply on July 2nd, but because on delays with the medicals I got trapped in the Visa Bulletin fiasco mess.
I've talked with several local lawyers and none of them has given me hopes beyond the F-2 status.
Some friends recommended to file I485, but I don't want to risk for an RFE :(
I'm trying to be strong for my family specially for my kids, the older one cries everytime he hears us talking about leaving PR.

VZLAN, have you explored the epossibility of a self sponsored petition? You have 10 years exp and a house/assets etc..you might be able to self-sponsor yourself based on these things. Look in google for 'self-sponsored green card'. There are people who do that and get through. You can do this in F2/F1 status too.

My heartiest congratulations to IV and Core. Over the last 2 weeks I found that IV was the most reliable and quickest in giving us information.
I have a question for IV , is there a possibility of increasing annual GC quota or atleast reusing unused Visas from previous years.

Around the second week of each month, a welter of activity breaks out on the online forums of Immigration Voice, a non-profit organization set up by employment-based legal immigrants in the US. Users on the site vie with each other to predict the cut-off dates for the next month�s Visa Bulletin. These dates dictate the hopes and lives of thousands of legal immigrants and owing to their sheer numbers, Indian and Chinese applicants make up the overwhelming majority of those who wait in line for employment-based US permanent residence.
Since 200x, barring a few anomalous months, the cut-off dates have largely languished between 2003 and 2004. While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
2) Lack of transparency throughout the process.
3) Lack of customer service in spite of regular ramping up of immigration fees.
4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCIS�s faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. That the United States, the most advanced country in economic and military leagues, can�t account for its legal immigrants speaks to the need for more highly-skilled immigrants to improve the status quo?

While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
2) Lack of transparency throughout the process.
3) Lack of customer service in spite of regular ramping up of immigration fees.
4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCIS�s faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. That the United States, the most advanced country in economic and military leagues, can�t account for its legal immigrants speaks to the need for more highly-skilled immigrants to improve the status quo?

The implications here are
1. USCIS cannot review the 485 application any time after it's been adjudicated and issue the physical card as soon as a visa number becomes available. In the light of fraud being rampant in the immigration system and given that the validity of an application is a sample at that time and economic circumstance, it's not easy to impose such a restriction on the adjudicators
2. Green cards are technically for a future job, whose description has been provided in the labor petition. In one way the RFEs issued during 485 stage is to ensure that this definition is not violated (ideally i.e.)
3. It will be perceived as a "whine". Given the freedom that EAD and AP provides to the recepient compared to the work visa, I don't know how sympathetic lawmakers will be to your cause.

Ironic, this poll is skewed. So we have 40 people saying yes and obviously the other 1000 viewers want to pray. You might drop a 50$ donation in your place of worship for a guesstimate that GOD is taking care of you. But, you dont want to pay 25$ to get a good estimate of when your turn to get GC might be? It is worth every penny to get a little peak into the future so everyone lets get this done.

Good progress- the drought for contributions to iv is hopefully over,
but we are not there yet. We need EVERY active member to contribute at least $20, remember there are not that many active people here.
It's very encouraging to see that some of the contributions are from recent members. Maybe pappu can let us know at some point how much this campaign has collected so far.
