All democratic party candidates and supporters MUST BE rejected and voted out from all elections - Prez, state and local elections. These people are socialist uneducated fools. All they want to do it take your money and distribute it to the illegal aliens as WIC coupons, food coupons, free health, free schools, free tution and the list goes on. Let's elect the republicans!!
I give a damn who the candidates are - remember, a president only signs a bill into law or vetos it, he has no other power.

If you find enough people and have solid plan in place, I am willing to pay anywhere between $500 to $1000 towards the lawyer's fees....
I am EB3-I and I have no intentions to port to EB2. But if you are planning to try to stop people who are willing to go through the hoops to get it done, all the best for you. In my opinion there is no legal ground for what you are trying.

This is protectionism at it's best. Think about it.

I was one of you and I mainly deal with many of you guys. Unfortunately, people want to come into this country in many different ways and just because we want to; doesn't mean they are going to let us.

    btw; see --------------------------------for my comments.

    I can't help asking this.
I have been following your posts for a while. I know you are quite knowledgeable in immigration.

But many of your posts indicate you have a bias against Indians. You seem to be going hard against H1B and saying Indians are screwing H1Bs.

I like to believe you are unbiased. Please let us know.

Moving fast: Tech lobbyist races to results ( By Kevin Bogardus | The Hill, December 11, 2007

I really dont have a strong partisan style. I just like getting things done, said Hellmann.

Under his helm, the lobbying team at the Information Technology Industry Council (ITI) has earned a reputation as a smart and aggressive advocate on Capitol Hill for the high-tech cause.

Hellmann, 46, joined ITI in 2001 after several years advising House Republican leaders, including then-House Speaker Dennis Hastert (R-Ill.). But politics was not always foremost on the Florida natives mind. He describes himself as a former beach bum who did not vote in the 1980 presidential election because he could not choose between Ronald Reagan and Jimmy Carter.

Now I know better, Hellmann said.

By college, Hellmanns interest in Washington had begun to simmer. He majored in political science and says he typically flipped to C-SPAN instead of MTV. In 1984, he took a job as a paid intern to then-Rep. Buddy MacKay (D-Fla.).

Hellmann soon after switched sides and began to move up the ranks. He worked for several prominent GOP lawmakers, such as Rep. Newt Gingrich (Ga.), before becoming a key adviser to party leadership. There, Hellmann helped to push through welfare reform, anti-poverty legislation and the No Child Left Behind Act.

The lobbyist always strived for results in Congress and saw the need for both parties to work together. Hellmann put that philosophy into practice as the liaison between then-House Majority Whip Tom DeLay (R-Texas) and the coalition of Blue Dog Democrats.

He knows substance, but even more importantly, he knows the institutional quirks and the process as well as anybody in town, said Rep. Adam Putman (Fla.), the House Republican Conference chairman. Putnam credits Hellmann with educating members on how the technology sector is a driver of the economy.

As ITIs senior vice president of government relations, Hellmann says it is not difficult to lobby for his trade groups members corporations like Dell and eBay since they are the coolest companies in the world.

We call it the wow effect, said Hellmann. But gone are the days when high-powered executives for tech companies could fly into Washington once a year, meet with lawmakers and expect to achieve what they wanted on Capitol Hill, according to the lobbyist. Now, a daily, active presence is necessary to keep check on Congress, which can affect the industry on multiple fronts.

Increasingly, other well-heeled business lobbies with decades of experience in Washington are weighing in against tech companies interests. We have to match them in shoe leather, said Hellmann.

Adam Kovacevich, Googles Washington spokesman, described Hellmann as an excellent advocate for the tech cause a good consensus-builder who has a great understanding of what is actually possible on the Hill.

He has never stopped building relationships with new generations of staff, said Kovacevich, who worked at ITI in 2005.

To maintain ITIs lobbying prowess, the trade group executive has helped assemble a team of type-A personalities who can work with both parties and understand how Congress works. Each lobbyist has between five and 10 years of government service, Hellmann estimated.

With Rahm, we moved a million miles a minute and we got things done. I felt ITI worked the same way, said Jon Hoganson, who recently joined ITI from House Democratic Caucus Chairman Rahm Emmanuels (Ill.) office. It wasnt about white papers and setting up meetings.

Hellmann credits ITIs quick action with helping to convince Congress to set a date for the country to move from analog to digital television. The trade group and its member companies formed the DTV Coalition, and stressed in Hill meetings that the sale of spectrum bandwidth could generate $10 billion in federal revenue, according to Congressional Budget Office estimates.

More recently, ITI has waded into the emotional battle over immigration. Hellmanns German-born parents came to America in 1956 on his fathers employment visa, so the debate has special resonance for the lobbyist.

There is a strong nativist element in Washington right now, said Hellmann. Republicans have weighed in against immigration reform.

Democrats, meanwhile, have railed against trade deals, another ITI priority.

With so much on the trade groups plate, Hellmann plans to keep ITI up to date on Washingtons happenings and sees no need to slow down.

Politics is a fast-moving sport, Hellmann said.

We, members of IV who are on H-1B visas, can bring our spouses and children with full rights to travel. Family members are NOT counted in the quota for H-1B. Spouses cannot work as their status is dependent (H-4).

Our agenda is to resolve the Green Card Queue. People are waiting in the queue since 2001. The current status of queue can be found at: (Look under the employment based numbers)

We do not mind waiting in the queue until we get the Green Card. The problem is that the Green Card process is currently Employer-Centric. In the sense, once the GC process is initiated (Let's say Microsoft), the employee has to stick with Microsoft until the Green Card is approved.

Even worse, we cannot get an official promotion during the wait as this will result in starting the GC process from scratch and inadvertantly sends their application to the end of the queue. Imagine Skilled Labor (people with BS, MS and PhD degrees in Science and Math) who are waiting in the queue for more than 5 years with out an official promotion and at employer's mercy.

The employer precisely knows that the employee is stuck with their firm until they get their GC and they can conveniently ignore our professional growth (pay raise, promotion, etc). Make no mistake:rolleyes: , on the record they always sympathize our plight but they will not do anything about it. They always want more H-1B numbers but not GC numbers. Talk about employer exploitation.

IV wants to make the GC process employee-centric so that the employers do not exploit the skilled labor.

The problem of mis-match between H-1B numbers and GC numbers is created because of the disconnect between two programs. H-1B numbers do not have country limits where as GC numbers have a country limit.

For example, let's assume that out of the current 65000 H-1B visas, 25000 are from India and 25000 are from China (First come first served basis) and the remaining 15000 are from the Rest of the World. However, the GC numbers have a country limit: 10000 for India, 10000 for China, etc. This results in a queue that will only increase with more H-1B numbers and a disconnected GC program.

IV members are not against H-1B program (we are here on this program) but at the same time the H-1B increase is not our agenda (we leave it to the exploitant employers who lobby for it). We want to make the GC process employee-centric so as to stop the employer-exploitation and not hinder our professional growth.

I am not aware of AFL-CIO/Programmers Guild agenda but my understanding was that they want to completely shut-down the H-1B program instead of reforming it. The bottom line is there aren't enough American Citizens who have advanced science and math degrees. So, we need a H-1B program. How to make this program more effective and less exploitative is debatable.

This thread is very interesting to me. I've kind of lived though both sides, and it is really aweful for everyone but the abusive employer.

My understanding of Immigration Voice's agenda is that this group is really for people who have H1B visas and are in the country already to bring their spouses and children here with full rights to travel and work, make sure renewals of H1Bs happen so you can stay in the country, and, even better, to convert H1B visas to green cards.

My understanding is that the only reason that Immigration Voice supports increased H1B visa numbers is because people whose current visas are about to expire, and family members, are counted in these same numbers.

Please correct if I'm wrong. I really would like to get this right.

Anyway, if I do have it right, it seems to me that the AFL-CIO position (give people green cards instead of H1B visas) bridges the core concerns of members of Immigration Voice and the Programmers Guild. Whether or not everybody recognizes this is a different story, but it is good to know where the overlapping concern is, and hopefully in long term, get people talking about a solution that really does try to bridge the gap.

I agree that credit crunch is worst we have ever seen and the worst is still about 9-12 months away. A lot of investment banks are going to be in trouble. I work for a big financial services comp and even though they say they are not affected, I know that their 'high-yeild low-risk' funds lost around $30billion. Who pays for this? investors? hmm China/Japan.. maybe. But Ben Bernanke is keen on doing whatever it takes to jumstart the economy. So he is printing dollars and reducing interest rates to historic lows(considering 60 year cycles). When I bought my first home in 2001, the rate was 8.5%. Whats it now 5.5%?
So my view is that inflation is a bigger problem that Ben B does not want to tackle in the near future(3-4 months). Well in times of inflation your savings/investment is better in real-estate than anything else. But definitely NOT cash.

So although we might be near the bottom of real estate market, we can never guesstimate the bottom until it has passed. My advice is, negotiate hard(buyers market) and get into a deal now. As a safety net, you can ask for a long escrow(around 180 days). That way you can backout of the deal if things head south. You've only lost the deposit(subject to arbitration at least in California).

Someone pointed out that Visa Status is a smaller issue, the big issue is if you can hold onto your investment for atleast 5 years, you are golden.

I believe that having a job(well paid) in recession is an investors dream as everything is on SALE.

Thanks for your posts. I'm glad to have a decent exchange of thoughts with you. I agree with you partly that 'non-state' actors are responsible and not Zardari Govt.. But Who created the non-state actors in the first place? Instead of paying unemployment benefits, who offered them job portability to Kashmir? Their H1B shouldnt have been renewed at all after they came on bench. How can a parent not be responsible for the errant child? The world wants to neutralize the errant child....but for the parent a child is a child after all and that too the one that served its interests once. If this child is abandoned, can future child ( with same objective) be created with the same ease?

Those are the questions that are haunting many Indians on the forums.

But I salute you and other folks for keeping this conversation civil.

Nice job and you and Alisa started a good thoughtful conversation.

I agree that war is not the best option but should not be discounted outright.
We are thinking too much of Pakistani nuclear weapons (and to some extent India's nuclear weapons as well). When Pakistan and India last tested these (1998), many experts thought these were fizzles. I could dig up one article that hints that 1998 tests are a possible fizzles.

    2. N. Korea tested nukes in 2006 and are definitely fizzles and these are built using the same techniques used by pakistan (AQ Khan actively involved).

    3. The other important aspect of nukes is the delivery. Pakistan's capability is suspect here as well. It is not sufficient just to have warheads and missiles (made in China), they should be tied together with proper trigger mechanism and it is uncertain if China delivered this technology to Pakistan or not.

With points 1, 2 and 3, it is reasonable to assume Pakistan can not take out India even with first strike and with nuclear weapons. I definitely think India's nukes are more potent. Assuming Indian nukes are just as bad as Pakistani nukes, finally it boils down to conventional war, and Pakistan can never beat India in a long drawn out war. The simple reason is that, India has a robust manufacturing base and much more robust economy and can continue to produce weapons and support war, where as Pakistan has to stop the moment it runs out of the weapons it bought fron US and China. Pakistan can not expect military supplies from any country once the war starts.

The only way Pakistan can win over India is to destroy India completely with nuclear first strike and it would have done that already if it had the capability.

If there is a war between India and Pakistan, India wins that war with or without nukes, period. So nukes should not be a deterrent for India going to war with Pakistan.

The other point every one is making is that wars can damage India economically. Not necessarily. Look at history and you will see that many countries prospered after wars (eg. US, UK, Germany, Japan etc. post WW-II).

There is one more good reason for India-Pakistan war. The major reason for failed democracy in Pakistan is its military. A war between India and Pakistan has one outcome, India's victory and destruction/weakening of Pakistan army. With weakened military, Pakistan has a chance to develop as a democratic nation, and that is good for the entire region. Proof? look at what happened after Indo-Pak war of 1971 and Indira Gandhi created Bangladesh. There was resurgence of democracy, with Bhutto becoming prime minister until that crook Zia-ul-Huq murdered him.

But I doubt any of this will happen now. I wish Indira Gandhi is Prime minister and leading India now.

I am a big supporter of Obama and I really want to see him as the next president, but this message about the EB issues are really shocking to me.

Obama as promised will cut outsourcing and create more jobs here in US, which in turn will create more demand in the job market.
Moreover, I strongly believe that Obama has mentioned the EB backlog issue in one of the debates. So, we can expect some good thinks from his government.

I am not sure how much the Durbin guy is going to influence in any of his decisions?
But in general, I think the country will be in a better shape if Obama is elected as a president.

    Lets hope for the best.

BTW, dont you guys think the Left party support the EB immigration compared to Right? Zoe Lofgren for instance.

I dont understand your argument, may be I misunderstood. Who will benefit from EB1 to EB3 spill over ROW or retrogressed countries. It likely EB3 ROW. So why EB3 Indian writing the letter? May be things should be more clear about what you want to achieve.

The way it is working for EB2, it is going to work exactly for EB3.

I was thinking of buying a car but I have decided to hold off on it untill the presidentials elections are over. If obama is elected president I will not buy the car and will basically go into 100% saving mode because you never know when Obama\Durbin might kick us out. Nobody knows what sort of draconian rules are going to be put in place for EB community by Obama and Durbin. I have no confidence in Obama\Durbin to show any compassion\fairness towards Eb community. There might be hundreds of thousands of people holding off on purchasing a house, car or any big ticket item because of Obama\Durbin cir and there hostility towards Eb community. Hope I am proven wrong but I have not heard a single positive thing out of obama regarding EB community. Even when he was specifically asked about the green card delays faced by EB community he gave a evasive reply. He is always boasting about support for legal immigartion i.e family based immigration and not eb. I am not a obama hater nor a mcccain supporter but just a worried EB guy worried about his bleak future with Durbin lead cir.

It is not clear what will happen to the existing applications, I don't think it would be simple to throw all the pending EB based GC applications out of the window and have everybody fall in line again in the new point based system....

Attacking Pakistan is a stupid idea. The hardcore hawks in Pak wants this only.
By war this side crores will die and that side crores will die. The Laskar e toiba will go to hiding in NWF and plan for next attack. India will be backward for 10 years and Pak will be backwards for 20 years.Do you want this ?

Don't attack Pak. It will be a failed state on its own. By war between us , China is going to gain. So, the people who want war with Pak by sitting comfortably in US, please think once again. It is not like going to picnic. It is life and death man.

America is failing in tackling terror in Iraq and Afganistan. Israel is failing in tackling the Hamas. Srilanka is failing with Tamil tigers. So tit for tat is not working. It will only aggrevate the problem.

Unless the fools in Pak understand the importance of real education and tolerance , they will go to drain .Now the whole world knows Pak is the culprit. They even disown their own citizen who got captured in Bombay attack.Such is the pathetic condition of proud muslim country .Shame !

My suggestion is ask US to attack Laskar e Toiba training facilities in Pak.[ Six americans and four isralies died in the Bombay attack. That is enough reason for America's attack.]
If US attacks Pak , the stupid people in Pak can't do anything. That way , Indian innocent jawans and common people will be spared.

Nobody is a war monger. Killing innocent Pakistanis is the worse crime. These are good people like us.
We want to attack terrorist camps.

Israel is a bad example. If Israeli don't counter-attack, they will cease to exist.
One attack will not kill the enemy. You must do it multiple times.

To think, US will take out LeT is a good idea but its not practical.
Nobody's gonna come to wipe your ass. You gotta do it yourself.

    If Obama becomes Prez

1)Sen. Durbin will play major role in immigration policy which may take us to Stone Age.
2)CIR is only resolution for the immigration ( Bills like HR 5882 will go away)

    If McCain becomes Prez

1)Anti immigrant lobbyist will take center stage and will not allow CIR to pass through
2)Smaller measures like HR 5882 will have chances to pass through

This is my opinion and it may differ from others. Its like catch 22, I have very little hope on either of them, more over based on the current economic situation. whoever the prez their focus will be on fixing the economy rather than immigration - my 2 cents

Our prayers are with God to get you and your family out of this difficult period. I know of a close friend who went thru a similar situation regarding distress sale of the house but finally it all worked out. So keep the faith and be strong. Good luck.

I applied for GC under schedule A in may06 .My husband filed as derivative. He received a notice of intent to denial last month .Reason being he did not have paystubs for a period of more than 6 months during 2000 and 2001.His employer at that time did not pay him even after he worked for 4 months then he took few more months to change his company(more than 180 days)In 2002 he went to India and came back .and in 2004 filed for a GC as primary petitioner and me as a derivative .last year he withdrew the petition after he received several RFE`S fearing the worst.Even though he no longer has GC filed as primary petitioner he received notice of intent to deny for the petion filed through me saying that his H1 was not legal as could`nt show proof for several months and that when he filed for AOS he used those years as work experience.
and now another problem is I applied for EAD in march and have not received new old ead expired 10 days ago.and now Iam not working.
We bought a house last year thinking that under schedule A we`ll get GC in no time. Now we know it is a terrible mistake. Now both of us can`t work and had to take my son out of daycare. and we have house payments to make.We put our house for sale weeks ago and so far no offers.I contacted local representative to expedite My EAD and also contacted USCIS to expedite it,
citing financial burden. We are spending sleepless nights and have no clue what to do for my EAD and his AOS.pLEASE HELP.
Did anyone face similar situation .Any suggestions are welcome.

I was saddened and anguised with the terrrorist attacks that happened in Mumbai. I hope India follows up on its tough talk and goes after the perpetrators, no matter their affliation or the consequences. That was a provocation and I would love to see LeT or anyone else responsible to pay for it.

But It is sad to see 'educated individuals' channeling their anger to demonize muslims who are equally upset with the Mumbai incident. Just like any religion/race, there are extreme elements among muslims. But this guilt-by-association should not have any place in modern society though sadly it does. There have been subtle and some not-so-subtle attempts on IV to protray all muslims as terrorists or all terrorists as muslim.

I agree that there are a lot of current terrorist activities that can be attributed to muslims and I condemn them. But Indian muslims have stood up against this latest incident. They are asked to wear their allegiance on the sleeve as if they are in some way responsible for this heinous crime. There are numerous examples of non-muslims who are terrorists but in my view that does not render the whole community as such. The gujarat genocide, the attacks on christians in Orissa and other parts are led by the VHP/RSS but the right wing marketing blitz has been so effective, a lot of people have defended this as a reaction. That is exactly the kind of excuse the LeT or any other terrorist organization would make.

Why is it so hard to say - Lets punish the guilty irrespective of their name or religion. Lets have a transparent Criminal justice system. Lets investigate any crime before guilty verdict is pronounced. That would render ineffective any propaganda that extremists use to recruit new members. Most of the people in this forum live in America and the law of this country would be in my view a good example of punishing the guilty irrespective of who and where they come from.

    10-01 05:45 PM
Engg from top school in India + MBA + CFA started the process of GC in 2000. Lost first round of GC in the black hole of backlog processing center and restarted again in 2004. Never was out of job even in the worst of economy and always got good pay from company.
CIR was a disappointment and I took PR from Canada since I lost hope with the system after 9 years in limbo and being a probationary worker without any career hope. My wife with her masters in computer had to remain on H4 for long and now when we have EAD we thought we could be a little better off, the broken system in USCIS again came up during EAD extension processing and gave us a jolt. EAD finally gets approved after several SRs, Infopass and ombudsman mail but only after the current one expires. If 90-120 were not enough, then at least allow EAD extension to be filed much before in advance.
H1B extension can work based on Receipt notice, 485 is filed based on EB and EAD extension applied based on pending EB based 485--BUT we can work only after we get the EAD in hand. Why? There are many gaps in the way USCIS works and there is no credible transparency for the fee that we pay to get the service.
We love CHANGE but would that change be for better?
