This is one of the more reasonable proposals heard here. To give it more credibility, I think we should add an earnings threshold to it. Something like 500K to 1 million in cumulative W-2 earnings. No matter what your country of birth or your educational qualification is, If you contributed significantly to this country and you are law abiding then you deserve a little respect so that you can do more of the same.
Sir that will not go too far because it will be very easy for Desi body shoppers to generate W2s and pay stubs for that amount.
Make it simple. if someone working from last 10 years paying taxes and no crime history, never violated any law...Grant them Citizen ship...not GC.

Ok Here goes:
1) Go to https://egov.uscis.gov/cris/jsps/selectusertype.jsp
2) Click on "To register as an applicant customer click here."
3) Accept the Terms and Conditions
4) Enter the information CORRECTLY.
5) Once done enter your I-140 SRC, LIN etc number without dashes by adding a case.
6) Either immediately or after a day or so, IF there is an update on ur I-140 LUD you will see it.

Could not able to understand from where this EB2 Vs EB3 scenario came up, silly.
If somebody says EB3 filer is inferior to EB2 (in a way), then it is ridicules. Being said that, nobody has asked to them to opt for EB3, it was just the situation they were in when they started their GC journey. Let it be their educational qualification, experience or job requirement, they opted to go with EB3 with full consciousness and also due to some compelling reasons. If EB2 dates are moving forward why EB2 filers needs to be blamed / targeted for that? This doesn’t make any sense either.
Also, now nobody is stopping them to convert from EB3 to EB2.
Let us just stop this EB2 Vs EB3 crap and do something constructive. These kinds of fights will not take us anywhere.

I am a bit surprised that you had to do a crazy search for a third person. I did send you guys my story. I am non-IT EB1 and I did get an initial phone call from Sunil but then did not hear back.... Any way good to hear that you did find the necessary people.

We were approached by a award-winning reporter to provide her two members of IV that fit two criteria
1) Should be non-IT
2) EB1 or EB2
Given the 20 stories we had only 2 such folks that fit the criteria and they who were gracious and spoke to the reporter. The reporter then wanted to speak to one more person and we did not have any readily available person. So we had to do a crazy search for a person that fits this criteria. We were able to find someone at the last moment and we did not squander our chance. But chances are pretty high that such a thing can happen in future!

I think there would be a substantial relief if unused visas are reallocated to oversubscribed countries as in 2003/2004.
Also the 'side' flow might help immensely.
As I stated earlier only a US Citizen can petition USCIS for release of information.
All we can do is speculate.

In my opinion by 'Using the unused EB2 visa for EB3 ROW instead of EB2 India', USCIS is following the law as congress pased it...The law may be not fair but that is a different issue...If you want to change the law you have to get that done from the congress...suing USCIS would get you nowhere....
People seem to think uscis/dos is doing it wrong and it should be going horizontal rather then vertical. However, since people just keep getting mad at it because they think dos is doing it wrong but are not willing to do something about it.
The main thing ac21 did differently then before enactment of ac21 was that it allowed unused visas from ROW to be used by other countries on a quarterly basis and not in the final quarter.
One of the frustrations is that dos/uscis was very lazy in approving cases and allowing 485 filings and weren't watching because they allowed too manyh people to file (as soon as there are more applicatoins then visa numbers they are supposed to establish cut off dates). They had more applications then what they can approve long before they actually established cut off dates (January 2005). However, people got spoiled. Now they are going back and being very careful about it. This situation should have presented itself much before it actually did.
