The intent of the H1B program is not to bring people in the country in "Anticipatory mode" as you put it. The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.
I agree. But intent of law usually gets distracted once reality set's in. Not sure how we comparing 1999 to 2007 is right. Because many things changed.
India which was doing low profile maintenance and support work became a global leader in outsourcing.
You can also count #of folks coming to US on F1. Significant % of them become H1Bs.
Again, I am not here supporting more numbers or less number in H1B. Because this forum and our organization is nothing related to H1B. We are for Employment based Green Card reforms. I rest my case....Thanks for interesting (and correct) opinions.

lasts even that long.. it probably will be exhausted during April itself..
well, I have to keep my hopes up. Since I HAVE to wait to get H4 extension before I can apply for H1 transfer, I'd like to see them last long enough so that I can get an H1 IN time, this year.
It can be so disappointing to get the job but miss the quota for 2 consecutive years    and then 2 years I was ineligible for H1 because of the 6 yr limit. :(
Anyway, every dog has its day and I am hoping this is the year when I get my H1. :D

After reading through all the posts at IV, I've decided to get the Atlas America Medical insurance for my parents. This is the only comprehensive insurance I could find and most others have limited coverage. The cost is around $900 for 3 months for a $500000 policy with $2500 deductible.
Could members who had this insurance post their experience?
Also, is there any other comprehensive plan available for visitors?
we used IMG international's/sirius international patriot america with a $250 decutible 90/10, for 50K...
one thing I noticed is this company takes a long time ( most other visitor insurance companies too I suspect) for settling cliams..we still have a claim not settled since for a one in december and most of these dont cover pre existing conditions and they are very very restrictive.. however there are some insuranc companies who provide a rider for pre existing conditions for an extra dough..
just make sure to call them for any major visit (hopefdully not needed but in any case) , the one above we got was a comprehensive NOT a limited one..still I think these insurance carriers in my opinion do their best to delay the claim and do whatever they can to sneak up on you with a surprise
I would love to hear from members who had a great CLAIMS experience (not price) with any visitor ins carrier..

BelmontBoy,
You didn't answer my question. Can you work for two companies processing your green card at the same time. I am working for employer A for 13 years and EB3 green card process pending for 8 years. Now while working for Company A, Can I start green card process through Company B(for part time work) and do porting to EB2? Please clarify. I am not intending to quit immediately after getting Green Card, I will work for 6 months after Green card for Company B(for part time)?
Is this legal to work full time for one company and part time for another company(I have EAD), both of them are processing green card at the same time? Is there a chance of getting RFE's OR Is there a chance of getting your original application getting rejected because of multiple employments and two green card process's at the same time.
Thanks
NN

Sameet,
Thanks for your response. My wife is in India currently. Wondering if we can get a letter from a pediatrician there.
Thanks,
GCisaDawg
No I wouldn't. Get it from the your child's pediatrician since they know the case history and will be able to word it correctly. Remember that the letter from the pediatrician is the basis which the certified civil curgeon for USCIS will use to apply for a waiver if he/she thinks it is necessary.

Well said and I agree. USCIS can be more transparent and be clear. They can always tell us that it would take X years and people can plan better and decide accordingly. Why cant they do it is beyond my reasoning. Frustrating part is they wont do that! Everyone makes alternate plans and has a threshold for waiting. I guess this is what nitinboston was trying to say that dont be obsessed about it. Many people took it wrongly and started called names which just shows immaturity. Anyways, GC or no GC one should live happily wherever that be :-)

Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
Also exluding STEM grads from quota.
Yes, I agree with all of that. It is just that 485 filing ability would do so much for so many, that I find it very attractive, especially if it can work at admin fix level

You need to relax and change your tone. This tone is very inappropriate in this forum. We are here to ask questions. You have no right to talk to people like this. Just because we are trying to understand a very obvious change in policy from USCIS, it doesnt mean that we are against you or anybody in the same position as you. I am happy that EB2 India has established a cutoff date, but I can still ASK questions on this forum. Stop patronizing people and CHANGE your tone.
since you seem to be completely unaware, let me rub some salt in....here, go read Act 202(a)(5) and educate yourself.....yeehaw !!!

So do you think they are going after AC21 folks as a scapegoat? I spoke to few people on this including lawyers and they say that "denials on 485" when 140 gets revoked is a common thing and usually the officer who issues the denial letter does not check and verify to see other details. Thats why they have to go through the MTR process.
Although, UN seems to suspect that there might be more beneath the surface here.
What still beats me is that if the 140 had problems, why would they even bother requesting for AC21 evidence and not just deny the 485 in the first place.
Unless..., when the 140 got revoked they realized that it had been more than a 180 days since the 485 was filed, and gave the applicant the benefit of doubt and asked for a new EVL, but while the applicant was in the process of replying to the NOID, they did some more digging, found that the underlying approved 140 had ability to pay (or other) issues and then denied the 485 on that basis.
UN,
You seem to be 'in the know' about this case/applicant, do you happen to know what the next steps are/would be/should be in this particular case?
Thanks,

Found one more without good education.
LOL! You are pathetic, aren't you. You judge people, yet know little about them. I am a Stern MBA alumni. And I vouch, it didn't bring me much. Education isn't the end all / know it all, when it comes to getting your job done. Thought and those brain cells count. Respect, and the ability to never undermine those who are in the same boat as you, count even more. But hey, do attempt that "Masters" -- perhaps you shall grow up.

Just in, Obama Administration wants to change law allowing employee to sue past employers and seek compensation. Current laws allows employee to sue for events up to 24 months in the past. This will change and suing employer is going to be a lot more easier. Bring it on baby, this time employees will be millionaires by suing body-shoppers. I am no longer going waste my money to buy lottery ticket :p
