    Omm,
    I dont think you need to worry much since you might have just started your GC process and you have not filed your 485 yet. If I am in your situation, I will definitely go for it if its a real good job and if thats what I have been waiting for. May be you can restart the whole GC process.
    Nothing is certain in the GC process. Find a right job and then start your GC. That ways even if you are stuck for several years, you dont need to go find another job.

    I hav seen many people in the forums getting RFE after invoking AC21. You know how USCIS works, right?? If they ever keep track of what they are doing and if they have a definite process in place, neither there will be any retrogression nor any of these forums. Be prepared for RFE if you are invoking AC21. Though you can survive that, imagine the period between receiving the RFE and responding to it. What if that happens in your 5th or 6th year of wait?? I pray that your wait is not that long.

    I agree ..provided they have done thier BS in US university ..i know 80 % of the indian students ( leave IITs/IIMs) will do MS because they either didn't get any job in india or admission to higher degree program

    Meeting with Congresswoman Zoe Lofgren�s staff, San Jose

    03/08/06

    A group of us met with the with Chief of Staff and Congressional Aide at Zoe Lofgren�s office in San Jose, yesterday. The meeting went very well and lasted an hour. The Chief of Staff was very knowledgeable about the issues. She ofcourse knew that the IV team had already met with the Congresswoman and the staff at her DC office. One of her first comments was about that meeting and she remarked that it was very good to have � an organized group� like IV. She was very appreciative of what IV was doing as an �organized group� � doing their homework and research and putting out presentations and materials that brought out the core issues very clearly and hiring a very competent lobbying firm to help execute our agenda. She wanted to know who made those presentations (thanks to Berkeley Bee!!!!!) J.. In fact, she repeated her appreciation quite a few times about IV. She also mentioned that she had read about IV in the Roll Call and was looking forward to meet the group.

    We went through the presentation, explaining the issues � most of which the Chief of Staff was already were aware of. The Congressional Aide was not aware of a few and we used the opportunity to explain the issues. Needless to say, personal examples helped to get the point across very well. While we went through the issues at the BECs and the USCIS, we quoted quite liberally from the Ombudsman report and the Presidents Economic report and from logiclife�s post on the backlog centers. At one point we were asked/ told that since these were infrastructure problems that are very deep, it is probably going to take time to completely address the fixes in the system. We again took that opportunity and told them about IV goals such as the 3yr H1B extensions instead of 1yr and the recapture of the visas lost between 2001 and 2004 - which would provide interim relief to the people affected by the backlog. We explained how the 3yr extensions instead of 1yr would relieve the USCIS of additional work and allow them to focus their efforts on actual processing / clearing of backlog. When they commented that the Dept of Homeland Security may want this to be a 1yr process, we pointed out that currently 3yr extensions are being offered to people who have filed for I485, so we are merely asking that the same be extended to people with their Labour and I-140 pending.

    They offered us a couple of suggestions:

    1. To talk to the Congress people �on the other side� especially in the Judiciary committee. They wanted us to consult with our lobbying firm first. They strongly felt that we should be talking to lawmakers who are not pro-immigration. They said that we may need to study their district and the industries there and try to point out how those industries are benefited by immigrants directly or indirectly.

    2. To collaborate with the giants in the Private sector who employ highly skilled legal immigrants because some of them have very loud voices on the hill.

    We do have an action to get back to them with a list of states that we know that don�t issue drivers license renewals for 1yr. Can someone please provide us with this information so that we can relay it back to them?

    They also wanted a softcopy of our presentation and the supporting materials. We are working on that.

    Overall, they had a very good opinion about ImmigrationVoice. To quote them again,
    �Very Organized Group� � and they felt that organized groups make a great difference,
    �Done their homework very well in terms of research, pinpointing the exact issues, presenting and communicating them in a way lawmakers / people understand�, �Have a very good lobbying firm�. They wanted IV to continue what we are doing and meet with lawmakers on either side (pro and anti immigration), so that when a �window of opportunity� presents itself, we can use it to our advantage. The Chief of Staff reiterated this point and mentioned how important it was to be prepared for this �window of opportunity�.

    My request to people who read this,
    1. If you are not a member of IV, please become a member and join hands with IV NOW. You can clearly see what an impact IV is making with the lawmakers in such a short frame of time.
    2. If you have not contributed, please do so NOW. It is absolutely required to retain this �very good lobbying firm� and make sure that our voices continue to be heard.
    3. Please join the membership drive started by logiclife at http://immigrationvoice.org/forum/showthread.php?t=305 and bring in 5 more members who can contribute monetarily / otherwise.

    Divorce in India takes a minimum 1 year to adjudicate if you were married less than 1 year. Otherwise, it is up to the discretion of the judge. Courts in India require a 'cooling period', with 'counseling / mediation'. Latter is basically a a sham.

    That said, as a trained mediator, and negotiator, I would say ... a win-win outcome is always better for all parties. What happens to be 'win-win' is of course subjective.

    Good luck in whatever you do! Trust me, things always work out well in the end.

    I am not saying the announcement tomorrow is a bad thing. I am just not very excited

    I was trying to fill up AP e-filing form. As I do not have a Middle Name, I didn't eneter anything in the Middle Initial field. It does not allow me to submit the form and shows the following error:

    WARNING: It is suggested that you provide your Middle Initial. Failure to do so may result in your application or petition being delayed or denied.

    Did anyone else encounter the same error and how did you resolve it?

    For me, my AP was approved (along with my wife and daughter) on Oct 1st 2006. My Notice date is Sept 10th. The LUD on AP was 10/04, which said that the approval was "mailed" on 10/02. Hwoever I recd it on 10/20 and I could see that it was mailed on 10/19 from USCIS office. So, atleast for APs, even the status shows that it's been approved and mailed as well, it seems that it's not the case. It's been taking couple of weeks to get them in hand. Hopefully this info helps some people who are still waiting for APs.
    I also took an Infopass appt, as we didn't recv FP notices yet. I opened a SR, but nothing so far. It looks that I may not get before I go to infopass next week.

    Most of the state colleges, (In my case, none of the state colleges), including under-grad and medical schools, will accept application, if you do not have GC/ US citizenship. I tried, wrote letters, but of no use.
    You can apply and get admission in private college, which of course cost much more.
    Also, we were not able to take any federal loans.

    You may like to talk to the admissions office of the universities. Last year when my daughter was applying for college, we had to go around and talk to them. Took an appointment and explained the case.
    We had asked only about admissions, resigned to the idea of paying out-of-state tuition. However, this counsellor got in touch with me, once the admission was confirmed, and suggested that I go to the bursar's office for tuition issues. And, there we got the great news that they had changed the rules in 2007, and that AOS candidates qualified for in-state tuition. Later we were able to get the same benefit for my elder daughter who was a senior in another state college.
    Imagine the relief of having to pay in-state after coughing up out-of-state tuition for three years. This happened in Georgia.
    So, to cut a long story short, yes you can be treated as in-state students for admission and tuition purposes. It only needs you to do some research and interacting with the offices. And of course, meeting some good persons. Incidentally, most of the counselors are great.

    thanks for your supportive words for CP filers now CP filers need some relief as they are not able to get an EAD/AC21. I think we could ask to allow CP filers to file 485 with out having dates current and conserdering their CP filing date to get EAD and AC21.

    Why is everyone blaming just the Chinese University for trying to circumvent the immigration system? It says 95% of the students were from Andhra Pradesh. These are the people who are causing delays in reforms and we pay the price by being stuck in the hole. The founders and all these students should be deported and banned from entering the US for life.

    I’ve been reading too many posts, queries and concerns and feel that I am not sailing alone.

    I have a few questions:

    1) How does USCIS work? Do they have a set of rules? Is there a law stating they would provide AP or EAD (for all legal eligible cases) within 90, 120, 150 or 200 days?

    2) How can a person who is trying to immigrate legally (tax paying) make USCIS answerable for all these delays?

    3) Does the law of the land provide any opportunity for us (people trying to immigrate legally) to question USCIS for the delay?

    I’m all questions. Please share your thoughts….

    The same 60% or more people in the US support the cause of solving the immigration system.

    Obama and his Attorney General are doing the wrong thing by interfering with state politics.
    As for the Arizona law, immigration issues fall under the federal jurisdiction - so it is the State that is interfering with the fed agency.

    How can these high ranking officials tell state law enforcement NOT TO enforce laws?
    The Fed is going after the law itself - and arguing on its unconstitutionality. Enforcing a law that is unconstitutional is not right

    The Supreme court will favor AZ even before the case starts. Slam Dunk.

    Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.

    Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...

    Question remains open:

    1. When are they going to increase the GC quota?
    2. When congress id going to do something?

    I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

    So let me guess, your parent applied under 245(i) in 2001 and thats why you have aged out. No thanks, that 245(i) amnesty has caused us enough problems with the labor certification backlogs.

    What was 245(i) amnesty?...just curious

    Also, It is a big concern for me when when some EB visa holder's kid age out and is left out of the process. If someone can show me that this so called dream act will help in that, i will support it and do my part.

    But Iam not getting on the field to bat for an illegal.

    My friend - the list provided the consulate is a list that is now being asked after thoughtful deliberations. Consulates do not fall easy prey to petty politics of local (US) congressmen or Senators.

    They have not mentioned that if you dont have any-one of these documents you cannot apply for an interview. If the petitioner is good enough employer there is not harm in going w/o one-2 docs missing and a explanation letter of why its not there.

    If the employer has tax filing for previous years, employee list and wage report to proove that employer has paid IN FULL and IN TIME to all employees irrespective of whether they were on bench or on assignment then there is nothing to fear......

    If you have been in similar situation (not being paid on bench...or employer is exploiting you) its your personal problem. Dont say that there is no mis-use and govt should not plug the hole if it has not done it in the past.
