You can change you job after 180 days with an approved i-140. And job description and duties should be same or similar. So would you say the job duties are same/similar?
Does that mean 180 after the I140 is approved or 180 after the RN of the I485 as long as the I140 is approved? (Even if it has been approved for only 2 months)

Dont ask me when you get an RFE for your skin test. I believe I read it on these forums that a couple of people were specifically asked about their skin test.
Even the doctors are supposed to give you a skin test and then the x-ray. If you have taken a skin test before, I think you can just take the x-ray now.

Most people from India will have PPD test positive as they have received BCG vaccine in childhood. PPD test in not mandatory. Negative chest xray is sufficient to prove that you are free from active TB (you may still have dormant infection but that doesn't matter at this point of time). Plus USCIS/CDC had published a guideline for civil surgeons instructing how to perform the Medical exam for immigration purposes and it clearly says that applicant can choose not to have PPD test and negative cxr will be sufficient.

I understand that Immigration bill is not an easy one to pass. If it is being introduced again, hopefully they are not going to have the exact same wordings. I am sure they would have learnt something from the previous failures and come to some agreeable compromise.
So i think it is good to have some hope and work towards making it happen. Lets not worry about failure. We have nothing much to lose.

Over 60% of the US and 90% of Arizona supports the law they passed.
The same 60% or more people in the US support the cause of solving the immigration system.
Obama and his Attorney General are doing the wrong thing by interfering with state politics.
As for the Arizona law, immigration issues fall under the federal jurisdiction - so it is the State that is interfering with the fed agency.
How can these high ranking officials tell state law enforcement NOT TO enforce laws?
The Fed is going after the law itself - and arguing on its unconstitutionality. Enforcing a law that is unconstitutional is not right
The Supreme court will favor AZ even before the case starts. Slam Dunk.
Lets wait and see!!

Our efforts are held hostage by both parties (It's simple), One party wants to win votes of one group and the other wants to wins votes as well of a different group. It's not about "DOING THE RIGHT THING". If it was about "DOING THE RIGHT THING" there would never had been a backlog. Backlog elimination center was created just to put some cases on hold and clear cases of 245i applicants (USCIS will never allow us access to that data)
3) DOING THE RIGHT THING....why unequal penalties of the parties who break the immigration Law. All punishment is directed towards the employee. EMployer only gets fine. Make punishment stricter for employers, (hit them where it hurts most, jail them and shut down their business)there will never be any illegal immigrant getting jobs. there whould be equal punishment for both.
4) Why this doble standard when it comes to immigration. why don't people oppose when jobs are transferred in name of outsroucing or shifting production to cheapr countries? Anti Immigants are biggest Hypocrites ever and Pro immigrants are not representins immigrants properly. No one focuses on the injsutice done to legal aliens.
5) I am EB3, I followed Law, I am in backlog because Govt did not process the cases in 2001 , 2002, 2003 in time and created a backlog and I resisted the temptation to break laws and buy Labor substitution AND I openly say that I oppsoe illegal immigration and amesty to illegeal immigrants (and I do feel sorry for them. god bless them they deserve a better life).
I am one of those who need Immigration reform immediately. Justice delayed is jsutice denied (rest is all face saving).

I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.
Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.
I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.
May be even though your PD is current,but according to CIS shit rule your receive date should also fall under the ProcessingDates and then only IO will look over your case i guess...:(
This is what happened when i was current in May/June'08 told by Infopass/IO response..again back to circle waiting waiting..

wow. for once (& only once) I feel sad for USCIS. They are damned if they do, and damned if they dont. Usually all talk of class action lawsuits have been for visa numbers that they wasted by approving too slowly. Now another one for going too fast... :D
Seriously, I would be very very happy they are for a change working really fast so no wastage of numbers this time around. common guys don't you think is it good for us over all. may be we will not see some movement for some time but at least you know that we are not suffering because of USCIS's inefficiency.

Maybe USCIS thinks that our cases mayn't become approvable within the next 15 months. This is just my theory, because I see lot of people have got FP but with early PD's
I dont think thats true. I know lot of people whose priority dates , are in 2006 and 2005 and they have received their FP.

I am one of the unlucky ones on EB3 india who missed the july 2007 bus. With my PD under EB3 India, I know I am looking at 10-15 year wait. So I am planning to switch jobs and apply under EB2. I have done some research and I know that the position and the qualifications both have to match to go through in EB2. Those have successfully ported from EB3 to EB2, Can you guys throw some light on whether USCIS has any specific requirements like salary, previous holders of the position etc etc for EB2. Also, if i apply I-140 under EB2 with the new employer and pay 1000$ from my pocket for premium processing, are there more chances of rejection/RFE due to premium processing?Pls help me get out of the EB3 shit.

Tell Embassy that you need to file I485, so they will an earlier appointment.
