I would not say substitution of labor is totally wrong. I left my previous company after having waited for a labor over 2 years and helped find a suitable candidate, who also had the same level of education and experiance and was an exact replacement for me (Sr.Program Manager -designation). My (old) company which is fortune 100 company was not ware of this substitution business till i told them they should use it when they spent money filing it for me and i am not using it. while consulting companies also use it when the original person left and they have someone else to fill in that role..
The concept becomes wrong when it sold and not really used for a replacement and i think those guys have to be identified like Narendra Mandalapa and punished.
I am talking about Desi bodyshops and not fortune 500 companies. This law or regulation of DOL causes more harm than good. For the good it does to 5% employers, it does harm to thousands of applicants whose dates are not becoming current because of people cutting in line by buying the approved labor certs. Please stop this unnecessary useless discussion here. And I am not "_truefacts". Folks, just like how u do IT or medicine, for politicians - politics is a career. They do whatever they can to be in power and in developing countries like India where unfortunately, corrpution still exists. Corrpution exists everywhere in different forms. Don't we all pay for EAD and AP every year because our country is retrogressed? Don't we all pay for MTR when we do everything based on law?
One has to accpept the reality and live with it and try to bring about the change within one's parameters.
People can argue just for the sake of arguements - but the reality is that we are all in it together. If there is an issue that affects all of us, it affects all of us - period. We can argue and counter argue but unless we all get on the same page and understand that there needs to be a solution rather than trask talk, things are not going to change for us.

As far as i can tell, the main issue is that there are not enough visas for Indian applicants. The possible EB1 misuse is a sideshow.
Currently, the EB2-I wait time is 20+ years. Even if there are no EB1 applications the wait time would reduce to 10+ years. EB3-I wait time is probably more than the life span of most individuals.

Guys,
I live in a place, Where we can find very few Indians. Out of 1500 units of apartments we are the only Indian family used to live in.
One fine day (of course relaized that was worst day) My kid is playing at the play ground and I saw one Indian couple was walking towards the ground. I was so excited (offcourse later exploited) that atleat my will get some company. He spoke to me nice and I introduced my wife. I gave my phone number ...
After 3 -4 days I got a call !!!! He said, one of his friend (big shot) is retiring this evening, if you guys can join, The Saga continued ..
We all went then I relaized that it is Quix !! I couldn't get rid of them for 3,4 months (Offcourse I am new to US that time). But atlast we told them we can not do ... Even after that he used to call us for atleast do this ... you don't need to do any thing we all take care of it.etc.

OK, let's assume the SC invalidates country-based quotas. All EB-based immigration has to stop at that point until new law is written and passed......
Isn't this we want. New Law. I am pretty sure when new law is being written and debated and passed, we could lobby for the changes we want. I believe, the EB process will not stop during this process because the govt machinery cannot say let the new law comes into force and then we process. They have to process the GC as per the existing law.
First we go the judiciary route. If we win that would be awesome. If we loose that will give us more visibility. More visibility could attract more sympathetic support than what we have right now. Also there will be clear distinction in senators mind between Illegal and Legal immigration. The hearings will expose the lies behind Lou D talk shows.
I believe that this process will act as a catalyst, to the entire process. We are already facing retrogression. Maybe another couple of years of extra wait would be worthwhile if this can bring in the reforms.:)

IMHO ... The reason why the bailout is needed is because credit is tight, no one has the money to lend any money to ANYONE no matter what your Credit Score is. They want money NOW and cannot wait till people will comeup and buy a home. This idea of attaching immigration related stuff will fly only if you are willing to pay a full house price and no mortgage is needed. In essence ... expanded EB5 program in the lines of the following points
1) Temporarily Increase EB5 nos to around 40,000 to 50,000.
2) Expand eligibility to persons and their dependents who buy homes worth 150% to 200% of national avg housing price at full payment.
3) Program sunsets in 1 month of enactment

Simple. If it wasn't for that ceiling the vast majority of the visas will go to applicants from the oversubscribed countries. Now this is not a bad thing if the visas are in unlimited supply. But since that's not the case, the country ceiling ensures that even people from smaller nations will get an equal oportunity to claim a visa before all the visa are grabbed by their BIG brothers and sisters. And what's more what ever is left is given back to the oversubscribed countries.
How can you call that unfair? Is it fair to deprive a person from a smaller country, equal chance to have go at his GC?

Looks like endless discussion is going on here..
I think that USCIS has done some injustice with EB3 ROW. And I would like to talk to an attorney about the possibilities to sue the USCIS about this. I need some people with me so that we can better explain our issues and form a group to ease the process.

If I cannot apply within the next one year, do you agree that I will have to spend again on:
- Lawyer fees for form preparation and accounting of changes in laws= $2000
- Medical examinations And Immunization costs = $300 (many docs dont' take insurance, they didn't in my area) * 2 = $600
- Photographs = $25* 2 = $50
- Courrier services, photocopying, printing, long distance calls = $200
So, once again, I am looking at spending: $2850. This money that I/employer spent last month is GONE. Who is responsible now? That's all i wanted to point out. When I said double, I meant spending $2850 twice, and also adjust for inflation. The above costs do not include USCIS filing fee.
To calculate the money that has gone down the drain, just multiply that by say 50000 applicants who will not be able to apply within 1 year. That's well over $100 million. This is not a small amount, one could start a pretty good size company that can effciently go through the backlogs.

None of the FEES has been accepted by USCIS as they even did not accept the petition. So the fees cannot be calculated.

Yes, the fees gets revised start July 30. But you need NOT pay again and again to extend EAD/AP, if requried. Need to calculate the difference. Also not sure if the Attorney's would charge twice as they have to resubmit the paper with little or no modification.
Money lost will be the amount spent on Medical Examination (In my case $550, as I ended up with a doctor of my choice out side my medical insurance network), So even if my conpany can reimburse, I cannot... Also per my attorney Medical Examination Reports are valid for a year, If we apply within a year, this is also not lost. If someone or his family has to rush back to USA, to file AOS, then the amount spent are waste. Loss of vacation and money.
My point is not to discourage any one, but when we wirte to media, folks will investigate all before they publish to main stream. We need to be fair and should provide the correct information, else we might loose the coverage.

Since the Lord Jesus has given his Judgement , there's not much we can do about the supposedly great man but talk about his great deeds when he was alive.
Apparently goons encouraged by the state started occupying the Sacred temple Simhachala lands left and right.Then after enough has been accumulated so called great man entered the scene saying govt is taking over the occupied lands ,which they started giving over to christian missionaries.Someone I know that visited their native place Visakha a month back brought this information .I was really amused all along about the helplessness of all the people like me.
Of course like many there's many more incidents that I have heard about this so called great man.Like many I'm amazed with the articles coming in the media in last few days which are oozing with this desperation to pitch the guy into some kind of fame (albeit after death)
